Security Interests in System. Except as otherwise provided in this Agreement, Trustees acknowledge and agree that Licensee may grant or cause to be granted to a Lender a security interest in the System and Licensee’s rights under this Agreement, and Trustees expressly disclaim and waive any rights they may have in the System at law or in equity. Any security interest in or mortgage of the System shall not create any right or interest in the Site or the Licensed Area and shall be subject to the terms and conditions of this Agreement.
Security Interests in System. The Judicial Council acknowledges and agrees that Licensee may grant or cause to be granted to Lender a security interest in the System and Licensee’s rights under this SLA as expressly provided in this SLA. Any security interest in the System shall not create any security interest in the Site or Licensed Areas and shall be subject to the terms and conditions of this SLA. 15
Security Interests in System. Except as otherwise provided herein and in the Agreement, User acknowledges and agrees that Owner may grant or cause to be granted to a lender a security interest in the System(s) and in Owner’s rights to payment under the Agreement, and User expressly disclaims and waives any rights in the System at law or in equity pursuant to this lease. Any security interest shall be subordinate to the interest of the User in the Premises and subject to the terms and conditions of this Agreement.
Security Interests in System. Except as otherwise provided herein and in the Agreement, Lessor acknowledges and agrees that Lessee may grant or cause to be granted to a lender a security interest in the System(s) and in Lessee’s rights to payment under the Agreement, and Lessor expressly disclaims and waives any rights in the System at law or in equity pursuant to this lease, except as expressly provided otherwise herein. Any security interest shall be subordinate to the interest of the Lessor in the Premises and subject to the terms and conditions of this Agreement.
Security Interests in System. The DGS, and HOST acknowledge and agree that LICENSEE may grant or cause to be granted to Lender a security interest in the System and LICENSEE’s rights under this SLA as expressly provided in this SLA. Any security interest in the System shall not create any security interest in the Site or Licensed Areas and shall be subject to the terms and conditions of this SLA.
Security Interests in System. The Town acknowledges and agrees that Entity Name may grant or cause to be granted to a lender a security interest in the System and in Entity Name’s rights to payment under the Agreement, and Town expressly disclaims and waives any rights in the System at law or in equity pursuant to this Agreement. Any security interest shall be subordinate to the interest of the Town in the Premises and subject to the terms and conditions of this Agreement; provided however the Town shall execute, or use best efforts to cause any holder of an interest in the Premises senior to that of Entity Name to execute, a form of a non- disturbance agreement reasonably acceptable to the Financing Party and the Town or such other holder.
Security Interests in System. Except as otherwise provided herein and in the Lease, Landlord acknowledges and agrees that Tenant may grant or cause to be granted to a lender or other project financing party, together with any Tax Investor (defined below), security or collateral agent, indenture trustee, loan trustee or participating or syndicated lender and their respective representatives, purchasers, transferees, successors and assigns (any of the foregoing, a “Financing Party”) a security interest in the System and Tenant’s interest in this Lease, and Landlord expressly disclaims and waives any rights in the System at law or in equity pursuant to this Lease. Any security interest granted to a Financing Party shall be subordinate to the interest of the Landlord in the Premises and subject to the terms and conditions of this Lease.
Security Interests in System. Except as otherwise provided herein and in the Lease, Landlord acknowledges and agrees that Tenant may grant or cause to be granted to a lender or other project financing party (“Financing Party”) a security interest in the System and Tenant’s interest in this Lease, and Landlord expressly disclaims and waives any rights in the System at law or in equity pursuant to this Lease. Any security interest shall be subordinate to the interest of the Landlord in the Premises and subject to the terms and conditions of this Lease.
Security Interests in System. Subject to Section 4.6 herein and to Section 18.2 of the SPPA, UNIVERSITY acknowledges and agrees that LICENSEE may grant or cause to be granted to a Lender a security interest in the System and in LICENSEE’s rights to payment under the SPPA, and UNIVERSITY expressly disclaims and waives any rights in the System at law or in equity pursuant to this SLA. Any security interest or mortgage shall be subordinate to the interest of the UNIVERSITY in the Facility and subject to the terms and conditions of this SLA.
Security Interests in System. Licensor acknowledges and agrees that Licensee may grant or cause to be granted to a Financing Party a security interest in the System and its rights in this Agreement, in accordance with the terms of the PPA. This Agreement does not grant Licensor any rights in the System other than those granted under the PPA.
