SELECTING RUNNERS-UP AND THE WINNER. A panel of five (5) judges (the "Panel") will review eligible entries and, based on the criteria set forth in Section 5(b) below (the "Criteria"), will select from the pool of all eligible entrants the top four (4) entries, three (3) of which the Panel will deem to be potential runners-up and one (1) of which the Panel will deem to be the potential winner (such three (3) potential runners-up, the "Potential Runners Up" and such one (1) potential winner, the "Potential Winner"). The Potential Runners-Up and the Potential Winner will be notified on or about Monday, April 16, 2007. Without limiting Section 4 above, NYLPI may, in its sole discretion, contact the Potential Winner and/or each Potential Runner-Up and require such individual, in order to continue to participate in the Contest, to sign consent forms and/or releases in connection with such individual's entry, as well as to have such individual's parent or legal guardian sign such consent forms and/or releases on such individual's behalf and affirm such individual's agreement to this Official Rules and Submission Agreement. In the event that the Potential Winner or any Potential Runner-Up is unable to comply with the foregoing, elects to end his or her participation in the Contest, is unable to participate further in the Contest for any reason, or is, in XXXXX's discretion, deemed to be ineligible to participate further in the Contest for any reason, NYLPI reserves the right to replace the Potential Winner or such Potential Runner-Up with an alternate entrant; provided that such alternate entrant will be subject to the terms and conditions of this Section 5. After the Potential Winner and all three (3) Potential Runners-Up have been finally determined by NYLPI to be eligible to continue to participate in the Contest (such Potential Winner, the "Winner" and such three (3) Potential Runners-Up, the "Runners-Up"), the Winner and the Runners-Up will be awarded prizes as set forth in Section 5(c) below. Odds of being selected as a Runner-Up or the Winner depend on the number of eligible entries received.

  • Conflict Between this Amendment and the Agreement This Amendment shall be deemed to revise the terms and provisions of the Agreement to the extent necessary to give effect to the terms and provisions of this Amendment. In the event of a conflict between the terms and provisions of this Amendment and the terms and provisions of the Agreement this Amendment shall govern, provided, however, that the fact that a term or provision appears in this Amendment but not in the Agreement, or in the Agreement but not in this Amendment, shall not be interpreted as, or deemed grounds for finding, a conflict for purposes of this Section 4.1.

  • WORK STOPPAGES, SECONDARY BOYCOTTS, AND JURISDICTIONAL DISPUTES 16.1 There will be during the term of this Agreement and as to any work covered hereby, no slowdown, no stoppage of work, no strike and no lockout, it being the good faith and intention of the parties hereto that by the execution of this Agreement, industrial peace shall be brought about and maintained, that the parties shall cooperate to the end that work may be done efficiently and without interruption. In the case of any violation of this Agreement the Employer and the Union shall be notified immediately.

  • PROVISIONS OF THIS AGREEMENT APPLICABLE ON ALLOTTEE / SUBSEQUENT ALLOTTEES It is clearly understood and so agreed by and between the Parties hereto that all the provisions contained herein and the obligations arising hereunder in respect of the Project shall equally be applicable to and enforceable against any subsequent Allottees of the [Apartment/Plot], in case of a transfer, as the said obligations go along with the [Apartment/Plot] for all intents and purposes.

  • Caisson Rock Caisson Rock is defined as material that must be removed from a shaft which cannot be penetrated faster than two feet per hour (fifteen minute minimum) using a rock auger with bullet-shaped hardened steel teeth (Kennametal bits or equivalent), and the drilling equipment should have the capacity to produce a continuous torque of at least 1,000,000 inch pounds and a downward force of at least 50,000 pounds (a Xxxxxx LLDH in good working condition) for piers up to seventy two inches in diameter. Use of equipment with greater torque or downward force modifies the definition of refusal to be the point at which the equipment cannot penetrate faster than two feet per hour (fifteen minute minimum). In rare cases, refusal may occur on a rock seam or boulder above the general massive rock surface. The compensation for Caisson Rock should include only material that cannot be penetrated by the rock auger at the specified rate.

  • Placement of DNS probes Probes for measuring DNS parameters shall be placed as near as possible to the DNS resolvers on the networks with the most users across the different geographic regions; care shall be taken not to deploy probes behind high propagation-­‐delay links, such as satellite links.
