Common use of Sharing of Information Clause in Contracts

Sharing of Information. Any Lender may, in connection with any assignment or participation or proposed assignment or participation pursuant to this Section 8.06, disclose to the assignee or participant or proposed assignee or participant, any information relating to the Borrower furnished to such Lender by or on behalf of the Borrower; provided that, prior to any such disclosure, the assignee or participant or proposed assignee or participant shall enter into a binding agreement enforceable by the Borrower containing provisions to preserve the confidentiality of any Confidential Information relating to the Borrower or any of its Affiliates received by it from such Lender, at least as favorable to the Borrower as Section 8.07.

Sharing of Information. Any Lender may, in connection with any assignment or participation or proposed assignment or participation pursuant to this Section 8.069.06, disclose to the assignee or participant or proposed assignee or participant, any information relating to the any Borrower furnished to such Lender by or on behalf of the such Borrower; provided that, prior to any such disclosure, the assignee or participant or proposed assignee or participant shall enter into a binding agreement enforceable by the Borrower Borrowers containing provisions to preserve the confidentiality of any Confidential Information relating to the any Borrower or any of its Affiliates received by it from such Lender, at least as favorable to the Borrower Borrowers as Section 8.079.07.
