Common use of Shipping and Back Order Policy Clause in Contracts

Shipping and Back Order Policy. Kyäni will normally ship products within five (5) days from the date an order is received. Xxxxx will promptly ship ordered items that are currently in stock. Ordered items that are out-of-stock will be placed on backorder and sent when Xxxxx receives additional inventory. Business Partners will be charged and given Personal Sales Volume on back-ordered items unless notified on the invoice that the product has been discontinued. Xxxxx will notify Business Partners and Customers if items are backordered and are not expected to ship within 30 days from the date of the order. An estimated shipping date will also be provided. Backordered items may be cancelled upon a Customer's or Business Partner's request. Customers and Business Partners may request a refund, credit on account, or replacement merchandise for cancelled back orders. If a refund is requested, the Business Partner's Personal Sales Volume will be decreased by the amount of the refund in the month in which the refund is issued.
