SIGNIFICANCE OF POTENTIAL IMPACTS. The potential for significant adverse impacts to the Trust lands listed above are minimal due to the nature of the proposed action which entails granting reciprocal easements in exchange for the state receiving all lawful access, with rights for public access, to a section that is currently land locked by private ownership and is difficult to manage. All of the parcels involved are located in the Billings City limits, or adjacent to the city limits, so these properties are all in the path of development. The proposed reciprocal access exchange would provide for improved access for all parcels in addition to providing some flexibility in future development. There are no natural features that could produce adverse impacts or species of concern occupying the parcels that are expected to be impacted by implementing the proposed action.

If TIPS receives a public information act or similar request, any responsive documentation not deemed confidential by you in this manner will be automatically released. For Vendor documents deemed confidential by you in this manner, TIPS will follow procedures of controlling statute(s) regarding any claim of confidentiality and shall not be liable for any release of information required by law, including Attorney General determination and opinion. Notwithstanding any other Vendor designation of Vendor's proposal as confidential or proprietary, Vendor’s submission of this proposal constitutes Vendor’s agreement that proper execution of the required TIPS Confidentiality Claim Form is the only way to assert any portion of Vendor's proposal as confidential.
