Common use of SITE IMPROVEMENT PERFORMANCE AGREEMENT Clause in Contracts

SITE IMPROVEMENT PERFORMANCE AGREEMENT. The Developer shall enter into a Site Improvement Performance Agreement (hereinafter referred to as “SIPA”) drafted by the City and before any permits for the development of Property are issued, which SIPA shall establish site improvement items and terms of completion of said items. Under the SIPA, a surety shall be provided to the City for two full growing seasons to guaranty the proper installation and growth of all landscaping items.

The Developer shall enter into a mutually agreeable Site Improvement Performance Agreement (hereinafter referred to as the “SIPA”) drafted by the City and before any permits for City, prior to the development release of Property are issuedthe Final Plat, which SIPA shall establish site improvement items and terms of completion of said items. Under the SIPA, a surety shall be provided to the City for two full growing seasons to guaranty the proper installation and growth of all landscaping itemsitems and completion of the Public Sidewalk Improvements.

Under the SIPA, prior to the issuance of a Certificate of Occupancy for any portion of the Property, a surety shall be provided to the City for two full growing seasons to guaranty the proper installation and growth of all landscaping items.
