Size of Load Sample Clauses

Size of Load a) The Contractor has the right to nominate the size of load provided the Carrier has the right to refuse a load that is beyond the legal capacity of the vehicle or the rated capacity of the mixer. b) Each Carrier shall be loaded to his maximum legal capacity wherever possible except in the case of a single load or message, or where a subsequent load would result in less than 3m3 being carried.

Size of Load a) The Contractor has the right to nominate the size of load provided the Carrier has the right to refuse a load that is beyond the legal capacity of the vehicle or the rated capacity of the mixer. The Carrier shall carry any load so nominated provided it is within the legal carrying capacity of the truck and there are no other adverse impacts. b) Each Carrier shall be loaded to his maximum legal capacity wherever possible except in the case of a single load or message, where a subsequent load would result in less than 3m3 being carried, or where the Contractor considers that 5m3 is operationally appropriate in which case the Carrier shall be loaded to 5m3.
