Safety Net. (1) The Master of every vessel occupying any Berth must cause a proper safety net to be suspended beneath the gangway. (2) While a vessel is loading or unloading cargo at any wharf the Master must cause a safety net or save-all of such a size and character to be suspended at such place or places as will prevent cargo from falling into the water. (3) A Master who contravenes this by-law commits an offence.
Safety Net. An employee’s salary will not be less than the Fairness Test applied by the Workplace Authority, contemplating the minimum wage rates and penalty payments. The fairness test will be applied against the relevant awards to ensure that employees are not disadvantaged in terms of wages or salaries paid as well as any protected award conditions. For the purposes of the fairness test, the salary in clause 6.1 and the conditions of employment in this agreement will, as a whole, exceed the wages and protected conditions of employment of the Clerical and Administrative Employees (Victoria) 1999, or any other award used for such assessment, at the time of lodgment.
Safety Net. 11.6.1 An employee with three (3) or more years of service whose ongoing position has been abolished and who has elected to resign may access the following Career Assistance Options. The maximum value shall not exceed $5,000 and shall be calculated on the basis of $1,000 for each two (2) years of service, prorated for partial years. Employees may elect one or more of the assistance options.

An earnings safety net and guaranteed minimum earnings as described in Schedule A : "Quarterly Safety Net", shall apply to the Carrier per quarter year during the term of the Contract of Carriage. The Safety Net will be administered on a cumulative basis, ie there will be adjustments up or down from quarter to quarter, as appropriate during the term of the contract. 5.2. The "Quarterly Safety Net" (Schedule A) shall be subject to rise and fall under the terms of this Contract. 5.3. The Contractor shall pay to the Carrier an amount not exceeding the "Quarterly Safety Net" (Schedule A) per quarter if the Carrier has earned less than the "Quarterly Safety Net" (Schedule A) at the end of the relevant quarter. The amount payable shall be calculated in accordance with the following formula: Net Quarterly Payment = QSN - A where: QSN = "Quarterly Safety Net" (Schedule A) A = the actual earnings of the Carrier during the relevant period. The Net Quarterly Payment shall be made in the pay period following the end of the relevant quarter. In any quarter when the quarterly earnings exceed the quarterly Safety Net, any previous amount paid by the Contractor to the Carrier as Safety Net shortfall will be recovered from the Carrier’s quarterly earnings which exceed the quarterly Safety Net. (An example of the calculation method is attached as SCHEDULE E.) 5.4. The Carrier is deemed available pursuant to Clause 5.6. The Carrier’s Quarterly Safety Net shall be reduced by 4/253 ths per day for each day the Carrier is deemed unavailable. 5.5. The Contractor and the Union shall mutually agree on a mechanism so that the Contractor is not disadvantaged by causes beyond its control and the Carrier is not disadvantaged by actions of the Contractor. 5.6. The normal work week is six (6) consecutive days , Monday through Saturday inclusive to a total of 253 days per annum as described in Schedule A. The Carrier shall report as directed by the Contractor on each normal work week day and compliance with such direction shall deem the Carrier available. Non- compliance with the Contractors direction shall deem the Carrier unavailable subject to the following exceptions : a) The nominated plant is closed or unable to produce; b) The agitator is unserviceable, except by accidental damage by the Carrier; c) The Carrier is on approved annual leave (two (2) weeks per annum); d) The Carrier takes approved sick leave under the Award (eight (8) days per annum); e) The Carrier has a roster...

Safety Net. BOC LTD - will endeavour to schedule work so as an SSP ( excluding the Team Leader) will average 45 hours per week worked, as there are environmental factors that can impact this intent the following arrangements will apply: (a) A system to record and track hours worked will be maintained by Specialised Delivery Service. (b) Handwritten daily team member activity records will be retained for at least two years. (c) An up-to-date output of hours worked will be available to each team member. (d) When exceptions to the schedule occur the SSP will contact the team leader to make alternative arrangements to service the territory or run, if this cannot occur the SSP can request to work additional hours on the given day and be paid the an additional hours payment as detailed in Appendix one. Certain criteria will apply when this occurs The SSP must complete an extras form detailing the exception and provide this to the Team Leader with the daily/weekly timesheet. The SSP will claim a 1 hour , 2 hour or 3 hour payment; additional hours under 15 minutes will not be paid.The SSP will not manage the run to work over normal hours one day and under on other days in a consistent manner, and/or average less than 45 hours in the week. If this is the case payment will not be made. When making a claim for payment where the SSP has worked over 45 hours in the week the SSP shall claim on a weekly basis for the actual hours worked on the day of each and any event not for the cumulative total of the additional hours. The Team Leader has final approval on such payments and will not authorise exceptions where no approval has been given prior to the exception. (e) Hours worked by team members can be reviewed by the Toolbox Meeting Team on a three- monthly basis. This meeting will recommend actions to address any anomalies, which may include changes to rosters, runs or xxxxxxx. (f) In the event that a team member averages less than 45 hours per week over a twelve month period, those team members’ hours will be considered as having averaged 45 hours per week for the year and he will not be deemed to owe hours to BOC LTD. Any hours worked record will be reset to zero for the next twelve month period. (g) Where a team member on a weekly basis has not completed required training commitments and has worked under 45 hours the available hours will be utilised for completing the required training as specified by the Line Manager
