Social and Environmental Liability. Both parties undertake to adopt appropriate measures to prevent, combat and reduce significant environmental impacts, which the activities carried out under this Term may produce. Liability for damages caused to the environment, resulting from any violation by one of the Parties (Infringing Party) to federal, state and/or municipal environmental legislation, will fall directly and fully on the Infringing Party, even if these damages result from a fortuitous event or force majeure.
