Commercial References. Serious Factory undertakes to request School’s authorization for using its name as a commercial reference on its Website or on any commercial material. To this end, Serious Factory will send to School a copy of the contemplated commercial reference publication. School undertakes to allow Serious Factory to use its name as a commercial reference except when the contemplated publication is likely to harm its brand image.

Commercial References. SMAPPEN authorizes the Licensee to use its name and any other distinctive sign belonging to it solely as a commercial reference on all types of media.
Commercial References. Unless otherwise stated, the ADVERTISER authorises KWANKO to use its name or mention it as a reference by any means within the framework of business relations between KWANKO and its prospects or customers. In case of termination of the business relationship, KWANKO shall retain the right to use the name and logo of the ADVERTISER as a reference, unless the ADVERTISER explicitly requests otherwise in writing.
Commercial References. The PUBLISHER authorises XXXXXX to quote its name or to mention it as a reference, by any means, within the framework of the commercial relations between KWANKO and its prospects or customers. In case of termination of the business relationship, XXXXXX shall retain the right to use the name and logo of the PUBLISHER as a reference, unless explicitly requested in writing by the PUBLISHER.
Commercial References. Licensee grants STREAMCORE the right to use its business name, trademarks or any other distinctive symbol identifying it, as a commercial reference appearing on any of STREAMCORE's commercial, internal or external communications or advertising materials. STREAMCORE authorizes Licensee to use STREAMCORE's trademarks and business names that relate exclusively to the software solely for the purposes of internal or external communication.
Commercial References. Michelin may refer to the fact that the Customer is a commercial partner in its sales documents, press releases and/or any other external documents. Force majeure. Neither Party shall be held liable for delays, cancellations, non-performance of its obligations or damage caused by a force majeure event, provided the Party asserting the force majeure event notifies the other Party of its existence within ten (10) days of the said event. It is expressly agreed that the following events shall be treated as force majeure events: pandemics, fires, explosions, lightning or power failures, strikes or labour disputes, water damage, wars, public disorder, terrorist acts, actions by civil or military authorities and damage arising from the operation or availability of a third Party’s communication services or networks. For the sake of clarity, COVID-19 may be equated to a force majeure situation. Survival. Upon termination or expiry of the Agreement, those provisions of the Agreement which by their nature are intended to survive will survive termination or expiry. It is especially, but not limited to, the case for the following articles of this Agreement: “Liability”, “Confidentiality” and “Miscellaneous”.

A part from what specifically set forth above regarding Software and unless otherwise agreed in writing between the parties, OSAIcnc retains ownership in any and all industrial and intellectual property right connected with the Products, including, but not limited to, designs and drawings, ideas, processes, methods and inventions, patentable or otherwise, together with patterns, know- how, skills and techniques, tooling-up and all other Products’ descriptive technical documentation. Therefore the sale of any Product by OSAIcnc shall not in any way confer upon to the Customer, or upon anyone claiming under the Customer, any express or implied license to any intellectual property rights of OSAIcnc or of its licensors, unless otherwise agreed between the parties in writing. All the Products shall be used and integrated by the Customer bearing OSAIcnc’s trademarks only. Sales under different trademarks, unless authorized in writing by OSAIcnc, are not allowed. Customers shall not have to reproduce the manuals of the Products, unless authorized in writing by OSAIcnc and towards the requested fees. The Client hereby authorizes OSAIcnc to mention its company name in commercial references for promotional purposes.
Commercial References. The Client recognizes the Service Provider's right to cite it as a commercial reference in its various sales and advertising documents, unless the Client requests otherwise in writing.
