Sole Lender. Notwithstanding anything to the contrary contained herein, until there shall be two or more Lenders, all references to the Agent herein and in the other Loan Documents shall be deemed to refer to Bank of America as Lender.
Sole Lender. Notwithstanding anything to the contrary contained in this Agreement or any Other Document, it is the intention of all parties that FGI will be the sole Lender hereunder and FGI agrees not to syndicate and/or assign any portion of the Revolving Commitment without Borrower Agent’s prior consent; provided, that:
Sole Lender. From and after the effectiveness of this Third Amendment, all references in the Credit Agreement to “Wachovia” are hereby deleted and all references to “Agent” or “Lender” or “Lenders” shall mean Regions Bank as the sole Lender under the Credit Agreement.
Sole Lender. As of the date of this Amendment, SunTrust Bank is the sole Lender.
