We only fit parts supplied by Capital Repairs Ltd to ensure quality of repair, safety and guarantee, if on occasion we agree to fit customer supplied parts due to our call / labour charges being kept at a very low level there may be an additional charge to fit customer supplied parts and additionally the guarantee on the repair will not be applicable. Customer diagnosed spare parts: All purchased spare parts from our spare parts department are sold to you on the understanding that it is your own diagnosis and should always be fitted by a Qualified Domestic Appliance Engineer using the correct tools; we do not advise diagnosis over the phone or counter as every situation is different and unique to every customer. We have own Engineers if you require our services to fulfil this task for you. Guarantee on supplied parts for your own use will not be guaranteed by our guarantee terms unless these have been fitted by a qualified engineer as in our trade parts can be damaged by externally caused conditions or another component inside the appliance, (an example of this is a printed circuit board being blown by a faulty motor). Spare Parts. We only fit A list of spare parts supplied by Capital Repairs Ltd for the Facility estimated to ensure quality be sufficient for normal operations of repairthe Facility for not less than three (3) years following the Commercial Operation Date is included in Schedule 4, safety Part 1 (Scope of Work) ("Spares Stock"). The list of Spares Stock includes the Supplier's prices (including without limitation the details of any costs for delivery in accordance with the Applicable Incoterm for each item.) Not later than fifteen (15) Business Days following the Commencement Date, the Project Company shall either: instruct the Supplier to order the Spares Stock and guaranteesupply the Spares Stock as part of the Supply Works; or notify the Supplier that the Project Company shall procure the Spares Stock from third party suppliers. If the Project Company has exercised its option to purchase spare parts as Spares Stock from the Supplier, the Price shall be increased as set out in Schedule 3 (Price and Payment Schedule). Please also see paragraph 34 for our returns policy on Project Company ordinarily stores Spare Stock and/or other spare parts. 25 Estimates Our spares department The following shall apply to the supply of further Spare Parts: the Supplier shall upon request by the Project Company, promptly provide the information as may be requested by the Project Company with respect to the relevant suppliers or Sub-Suppliers of any Spare Parts that will enable the Project Company to directly procure Spare Parts from such suppliers or Sub-Suppliers; and no later than one hundred and fifty (150) Business Days prior to the Scheduled COD, the Project Company may order additional Spare Parts to top up the Spares Stock (whether or not the Project Company exercised its option to order the Spares Stock from the Supplier) at the prices set out in the Scope of Work ("Top-Up Spare Parts"). If the Project Company exercises this right, it shall submit a Variation Order for the Top-Up Spare Parts pursuant to Clause 21.5 (Variations). The procedure set out in Clauses 21.1 to 21.4 (Variations) does not apply to such a Variation Order. The Supplier shall arrange delivery of the Top-Up Spare Parts in accordance with Clause 4.16 (Transport, Storage and Delivery) to ensure that they arrive on Site prior to the Scheduled COD. The Supplier shall: monitor the status of the market for Spare Parts in accordance with the Prudent Industry Practice; and promptly notify you the Project Company if prior to the expiry of the relevant Defects Warranty Period the Supplier becomes aware that either: any party from whom any of the Spare Parts was procured intends to cease manufacture of the relevant Spare Part; or such Spare Part could be expected to cease being readily available on the open market. The following shall apply to the alternative sources of Spare Parts: nothing in this Agreement shall affect the right of the Project Company to make or have made or have supplied spare or replacement parts from any sources in addition to those supplied directly by telephone or email original equipment manufacturers ("Alternate Spare Parts"); during the relevant Defects Warranty Period, if the spare part required is Project Company intends to exercise such right it shall notify the Supplier of an expensive nature prior to ordering, we would normally contact you within 24 hours on this but if there is the use of any Alternate Spare Parts; the Supplier shall have a delay in sourcing the part or the manufacture cannot identify the part there could be a delay in obtaining the correct information period of five (part number inquiry), in this case we will contact you immediately we here 5) Business Days from the suppliers date the Supplier receives such a notice from the Project Company, to respond with any reasonable objection on the use of such Alternate Spare Part, provided that the Supplier does not respond or responds later than five (5) Business Days from the day of it receiving the notice, then the Supplier shall be deemed not to have objected; and if the Supplier has responded with any such reasonable objection not later than the aforementioned five (5) Business Days from the day of it receiving the notice, the Project Company shall still be entitled to proceed with the use of such Alternate Spare Part but the Supplier shall not be liable for any consequences resulting from the objected use by the Project Company of such Alternate Spare Part. The Supplier warrants that the Spare Parts being supplied by the Supplier to form part of the Supply Works shall: be new when installed (unless the Project Company and Supplier agree otherwise in advance and in writing); be of good quality and good condition and which is reasonably intended to perform in a manner similar to the replaced part; be handled, stored, delivered and installed (if applicable) in accordance with manufacturer's instructions and in a manner that does not void or impair manufacturer's warranties or guarantees; and conform with: the requirements of this is normally only Agreement; Prudent Practice; and all applicable to unusual parts or old appliancesLaw.

Spare Parts. We only fit parts supplied by Capital Repairs Ltd to ensure quality of repair, safety and guarantee, if on occasion we agree to fit customer supplied parts due to our call / labour charges being kept at a very low level there may be an additional charge to fit customer supplied parts and additionally the guarantee on the repair will not be applicable. As we repair most makes of appliance the parts delivery time frame does vary considerably, we always endeavour to obtain parts within 3 days if possible but this can vary depending on the manufacturer and the stock holding stockholding situation at the suppliers end also the age of the appliance has a significant bearing on this, in general though if we have a delay on the part all companies will also have the same delay on the same part, If the parts are deemed to be obsolete the call / labour charge will still apply. It is not in our interests to delay the part as our aim is to get your appliance up and running as soon as possible. On arrival of the part to our warehouse we will call, text or email you to arrange a convenient fitting date. Special Non stock ordered parts will require a deposit or full payment at the time of order as these are quite often non- returnable nonreturnable and specifically ordered for your appliance at your request, if orders are cancelled after you requesting a spare part or goods and us placing the order, the deposit or payment for the goods will not be refunded, we will however contact the supplier in order to try to get it sent back on your behalf but there may be a return to stock charge levied by the supplierssuppliers which we will have to pass on to the client additionally if non stock parts are ordered and cannot be fitted on our return visit due to the condition of the appliance due to nuts, bolts, fixings and certain components being seized corroded or damaged preventing the fitting of the parts, again we will endeavour to return the parts on the grounds listed above reference Non stock ordered parts. Parts that are not required when our engineer comes to fit them due to the diagnosis being incorrect in any way will be refunded at full costcost unless covered by the above. Customer diagnosed spare parts: All purchased spare parts from our spare parts department are sold to you on the understanding that it is your own diagnosis and should always be fitted by a Qualified Domestic Appliance Engineer using the correct tools; we do not advise diagnosis over the phone or counter as every situation is different and unique to every customer. We have own Engineers if you require our services to fulfil this task for you. Guarantee on supplied parts for your own use will not be guaranteed by our guarantee terms unless these have been fitted by a qualified engineer as in our trade parts can be damaged by externally caused conditions or another component inside the appliance, (an example of this is a printed circuit board being blown by a faulty motor). Capital Repairs Ltd cannot accept any responsibility for any consequential damage, loss or personal harm whatsoever due to parts being fitted or attempted to be fitted by a non-qualified person. Please also see paragraph 34 for our returns policy on spare parts. 25 Estimates Our spares department will notify you by telephone or email if the spare part required is of an expensive nature prior to ordering, we would normally contact you within 24 hours on this but if there is a delay in sourcing the part or the manufacture cannot identify the part there could be a delay in obtaining the correct information (part number inquiry), in this case we will contact you immediately we here from the suppliers this is normally only applicable to unusual parts or old appliances.
