Common use of Special Power to Act for Artist Clause in Contracts

Special Power to Act for Artist. ‌ (A) Authority‌ Whenever it is provided in the ITA or in any ITA Engagement Contract that something may be done by an Artist: (i) at the option of, or with the consent of, or at the request of Equity; (ii) on the demand of, or with the consent of such Artist, then: Equity, representing the Artist, has, and is given, authority to act for and in the place of the Artist, and to assert their position, or make their request or demand, as the case may be, with all of the power and authority of the Artist themselves without liability to itself. (B) Consent‌ In all cases where the consent or approval by Equity is required to modify or limit the rights of any Artist, said action will be taken on behalf of Equity in writing by the Executive Director or an authorized delegate only. Such consent or approval will be at Equity's sole discretion.
