Exclusive Service of the Artist. Except as otherwise provided for in the CTA Engagement Contract, the Artist shall not accept any concurrent engagement from the date of beginning of rehearsal, and until said CTA Engagement Contract is lawfully terminated, without the written consent of the Theatre. The Theatre shall make every effort to accommodate the Artist's request. In the case where an Artist has received permission to accept a concurrent engagement, he/she shall fulfill all the terms and conditions of the original contract, particularly as regards rehearsal and performance provisions, unless permission for the Artist's absence is specifically described (dates, times) and agreed to by the Theatre in advance in writing. Failure to comply with these terms may result in the original Theatre requiring the Artist to terminate the concurrent engagement forthwith.

Such consent shall not be unreasonably withheld. If the Engager grants a release, the Engager may deduct one-seventh (1/7) of the weekly contractual fee for each day the Artist is released. If the Engager grants a release from a pro-rated week, the Engager may deduct one-sixth (1/6) of the weekly contractual fee for each day the Artist is released.
Exclusive Service of the Artist. Except as otherwise provided in the Individual Artist’s Contract, the Artist shall not, without the Engager’s written authorization, accept any other engagement in the capacity of dancer during the term of the Individual Artist’s Contract. Should the Artist be given written consent to accept another engagement during the term of the Individual Artist’s Contract, which does not require the Artist to miss days of work, the Engager will not make an adjustment to the Artist’s weekly salary. In the event an Artist is given written consent to accept another engagement during the term of the Individual Artist’s Contract, which does require the Artist to miss days of work, the Engager may reduce the Artist’s weekly salary by one-sixth (1/6) for every day of work missed. It is the responsibility of the Artist to ensure that insurance is in place to cover their work away from the Engager. In either case the Engager accepts no liability for illness or injury which has occurred as a result of the other engagement. Written authorization in the form of a Rider to the Individual Artist’s Contract shall be produced by the Engager and a copy shall be provided to CAEA.

The Artist shall, however, have the right to accept other engagements, not conflicting with the fulfilment of his/her duties under said contract, provided he/she obtains the written consent of Engager with reasonable advance notice to Engager.

If the Artist is a Principal or Soloist in the term covered by said contract, the Artist may enter into a written agreement to be annexed to said contract, agreeing not to accept any other engagement and to render services exclusively to the Engager and not to render services to any other person or corporation without the written consent of the Engager. The Artist shall recognize that it is the Artist’s responsibility to perform under the CAEA contract in the live theatre. If during the term of engagement under the CAEA contract, a Principal dancer or Soloist receiving star or featured billing is also engaged for a radio or television broadcast, the Artist shall require, as a condition of that engagement, that any announcements, written or otherwise which publicize appearance on radio or television, must expressly mention that the Artist is currently appearing with the company.

Should the Artist be given written consent to accept another engagement during the term of the Engagement Contract, which does not require the Artist to miss days of work, the Ballet will not make an adjustment to the Artist’s weekly salary. In the event an Artist is given written consent to accept another engagement during the term of the Engagement Contract, which does require the Artist to miss days of work, the Ballet may reduce the Artist’s weekly salary on a prorated basis for every day or part day of work missed. It is the responsibility of the Artist to ensure that insurance is in place to cover their work away from the Ballet. In either case the Ballet accepts no liability for illness or injury which has occurred as a result of the other engagement. Written authorization in the form of a Rider to the Engagement Contract shall be produced by the Ballet and a copy shall be provided to Equity. For the mutual benefit of the Ballet and the Artist, the Artist may inform the Ballet if the Artist is to appear publicly as a performer.
