Stand-By Pay. Employees are entitled to stand-by pay if required to remain on the Employer’s premises or so close thereto that the employee cannot use the time effectively for his/her own purposes. Stand-by payment shall be at the regular, or overtime rate of pay, whichever is applicable. An employee who is not required to remain on the Employer’s premises but is merely required to leave word at his/her home or with the Employer where he/she may be reached is not working while on call. If an employee is called back to work, the provisions of Section 2 apply. Any employee who is place on call shall not be required to perform any duties the employee is not qualified to perform.

Stand-By Pay. An employee is entitled to stand-by pay if he/she is required by the Agency in writing to be on stand-by, that is, to be available for possible call to work. If it is not practical to notify an employee in writing regarding stand-by status, the Employer may utilize oral or telephone means. Stand-by status may be canceled by telephone, providing written notice of such cancellation is provided to the employee within forty-eight (48) hours. An employee entitled to stand-by pay shall receive twenty-five percent (25%) of his/her base rate of pay for each hour he/she is in stand- by status. Stand-by time will be excluded from overtime calculation. Stand-By status shall be distinguished from Call-Back status by the following: 1) Direct notice of the requirement, as in the preceding; 2) Employee’s off- duty activities are specifically restricted by the Employer; 3) Employee is given a specific period of time during which he/she must respond to any summons from the Employer with the consequence of discipline for failure to respond/report. Once summoned to report, Stand-By pay will continue until the employee reports and actual work is performed, at which time the pay provisions of the Call-Back Section (Section 13.08) will apply and Stand-By pay will cease. An employee required to carry a pager while “on-call” is not in Stand-By status unless specifically notified that he/she is to be on “Stand-By” status.
Stand-By Pay. Employees required to restrict their off-duty activities in order to be immediately available for duty when called, will be compensated for time spent in standby status. Rate of compensation for standby status will be compensated at a rate of $1.00 per hour. Employees who, on the effective date of this Agreement, receive standby in excess of those rates shall continue to do so. In addition to the pay received while on standby, an employee called to work will be paid at his/her regular salary for all hours worked.

Stand-By Pay. A. A bargaining unit employee who is directed by the Chief or other command personnel, to restrict off-duty activities to be immediately available for duty will receive compensation in accordance with this Article for the entire time they are required to perform standby duties.
Stand-By Pay. Notwithstanding Article 8.6(e) the City offers two (2) days off to be granted to designated employees in lieu of standby for one (1) full calendar week of standby duty (a week is defined as 4:30 P.M. Friday to 4:30 P.M. the following Friday). Current CMS practices (only the Department of CMS employees) providing for a volunteer response program, whereby employees are not required to be on stand-by, but who perform work via telephone during their normal off hours shall continue to be paid a minimum of one hour’s pay. (RC-10 only) In the event the Employer initiates or seeks to initiate a Stand-by procedure (which shall be defined as a requirement to keep the Employer informed of his/her whereabouts on off-duty time and to be available for possible recall for work, either on a day the employee was not scheduled to work or for a period of time after completing the employee's work day), the parties shall negotiate the impact of such decision.
