State Commitment of Resources. 4.2.1 As provided at 23 U.S.C. 327(c)(3)(D), Caltrans will maintain the financial resources necessary to carry out the responsibilities it is assuming. Xxxxxxxx believes, and the FHWA agrees, that the financial resources contained in the renewal package appear to be adequate for this purpose. Should the FHWA determine, after consultation with Caltrans, that Caltrans’ financial resources are inadequate to carry out the USDOT Secretary’s responsibilities, Caltrans will take appropriate action to obtain the additional financial resources needed to carry out these responsibilities. If Caltrans is unable to obtain the necessary additional financial resources, Caltrans shall inform the FHWA, and this MOU will be amended to assign only the responsibilities that are commensurate with Caltrans’ financial resources.

The DOT&PF’s substantial compliance with the Original MOU demonstrates that the DOT&PF’s financial resources are adequate for the purpose of fulfilling the terms of this MOU. Should FHWA determine, after consultation with DOT&PF, that DOT&PF's financial resources are inadequate to carry out the USDOT Secretary's responsibilities, DOT&PF will take appropriate action to obtain the additional financial resources needed to carry out these responsibilities. If ODOT is unable to obtain the necessary additional financial resources, ODOT shall inform FHWA, and this MOU will be amended to assign only the responsibilities that are commensurate with ODOT's financial resources.

If FDOT is unable to obtain the necessary additional financial resources, FDOT shall inform FHWA, and this MOU will be amended to assign only the responsibilities that are commensurate with FDOT's financial resources.
