Step 3. Agency Head. If the grievance remains unresolved, the Association, within ten (10) days after the response of the Chief Executive Officer, or designee, may appeal the grievance to the Agency Head of the affected Department, or designee. Within ten (10) days of receipt of the written grievance, the Agency Head, or designee, shall arrange a meeting with the grievant(s) and/or the Association representative and endeavor to mutually resolve the grievance. Within ten (10) days of the meeting of the parties, the Agency Head, or designee, shall respond to the grievance in writing. If the Appointing Authority and the Agency Head are the same, this step shall be eliminated and the Association shall immediately proceed to Step 4 of the Grievance Procedure.
