Common use of Step-Time Limits Clause in Contracts

Step-Time Limits. Failure of the employer at any step of the grievance procedure to render its decision on a grievance within the specified time limits for that level shall result in the Union having the ability to advance the grievance to the next step; provided, however, that the notification to advance to the next step is received no later than five (5) days after the decision was to have been rendered. Failure of the grievant to process his/her grievance within the specified time limit for that step shall be deemed a withdrawal of grievance without prejudice.
