Stop Payment. You may initiate stop payment requests online via the Online Banking System only for paper checks you have written (non-electronic) on your Bank accounts. The System allows you to: (1) place a stop payment order request of up to six (6) months in duration; or (2) determine the paid status of a check. If you use the Services stop payment feature, then you must follow the procedures and specification described in this Agreement. The cut-off time for us to receive a stop-payment request is 5:00 PM on a business day and a stop payment request received after that time or on a non-business day will be processed on the next business day. You must provide the Bank with complete and accurate information in a timely manner on: the account number, the date of the item or check; the item or check number; the EXACT amount of the item or check (dollars and cents); the payee name and the reason for the stop payment. If any information is incomplete or incorrect, the Bank will not be responsible for failing to stop payment on the item or check. You agree to indemnify the Bank against any loss for the amount of said check and all expenses, costs and consequential damages, if any, incurred by the Bank because of refusing payment pursuant to your stop payment order. You agree not to hold the Bank liable on account of payment contrary to your stop payment order if same occurs through inadvertence, accident or oversight, or if by reason of such payment other items drawn by you are returned insufficient. Stop Payment. You Stop payments of checks drawn on Customer’s Account(s) are subject to the terms and conditions of the Account Agreement. Notwithstanding anything in the Account Agreement to the contrary, Customer may use the Services to initiate stop payment requests online via the Online Banking System only orders for paper checks you an individual check or a range of checks. Bank shall have written (non-electronic) on your Bank accounts. The System allows you to: (1) place a no responsibility for losses resulting from any delay in Bank’s receipt of stop payment order request orders transmitted by means of up to six (6the Bank Internet System or for Customer not taking additional actions when a response message from the Bank Internet System indicates a response other than “Stop Payment was Accepted.” Customer must provide Bank with the EXACT CHECK NUMBER OR RANGE OF CHECK NUMBERS. When known, Customer should provide the EXACT AMOUNT OF THE CHECK, the NAME OF THE PAYEE(S) months in duration; or (2) determine and the paid status of a checkISSUE DATE OF THE CHECK(S). If you use the Services stop payment feature, then you must follow check number is incorrect in any way or the procedures and specification described in this Agreement. The cut-off time for us to receive a stop-payment request is 5:00 PM on a business day and a stop payment request received after that time or on a non-business day will be processed on the next business day. All other information must be reasonably accurate. Requests entered on the current day may not be effective until one (1) Business Day after receipt, and after Bank has had a reasonable time to act on the request. Requests made on a non-Business Day or on Saturday, Sunday or federal holidays are entered on the next Business Day but may not be effective until the second (2nd) Business Day after receipt. Stop payments using the Bank Internet System are effective for three hundred sixty-five (365) Calendar Days unless renewed before the end of the 365-day period. Except as otherwise provided by Compliance Laws, Customer shall not have the right to stop payment on or recall any payment order or transfer request given hereunder after it has been transmitted to Bank. Only stop payment orders initiated or recalled through the item or check. The Bank shall have no responsibility to determine the accuracy of such information. Stop payment requests which cover a range of checks or items that are missing or stolen Internet System will be processed without regard to displayed on the dollar amount. Prior to requesting a stop payment, you should first verify that the Customer Check has not already been posted toyour Account. You understand that the Bank is not and you are responsible for determining whether a Customer Check has or has not been paid. The Bank agrees to enter the stop payment order on its main computer system within a reasonable period of up to six (6) months in durationtime after it receives the request; or (2) determine however, no stop payment order will be considered as received by the paid status of a checkBank until the stop payment order has been received and approved by the Bank. If you use the Services stop payment feature, then you must follow the procedures and specification described in this Agreement. The cut-off time for us to receive a stop-payment request is 5:00 PM on a business day and require immediate action regarding a stop payment request received after that time or on a non-business day order request,you must call your branch and speak toa branch representative. No stop payment order will be processed on effective against a Customer Check that was paid prior to the next business day. You must provide time the Bank with complete received and accurate information had a reasonable period of time to respond to the stop payment order. Youmay not stop payment on an official check, certified check, cashier’s check, teller’s check or bank draft issued by the item Bank. Youmay not stop payment on Customer Checks governed by any separate agreement, such as a check guaranty agreement. Youmay not stop payment on a Customer Check after the Bank has accepted or checkotherwise become accountable on the Customer Check. The Systemmay not be used tostop payment on any automatic entry, such as automatic monthly drafts or ACH debit or credit Entries, or any Payment Order after execution by the Bank, and the Bank shall have no responsibility may ignore these types of stop payment order requests. You acknowledge that the Systeminformation available regarding the status Customer Checks will not include transactions (including cash payments) on Customer Checks that occur on the same business day as the date on which Bank receives thestop payment order request. Youacknowledge that a transaction search using either the System or the Bank’s main computer will not necessarily reveal whether or not a Customer Check has been paid until the banking day after the banking day on which the Bank receives the stop payment order request. Any loss suffered by you due to determine your decision toissue a new or replacement Customer Check, or to take any other action, based on information available through the accuracy of such information. After the expiration of the stop payment order,a Customer Check may be paid even though the Customer Check is stale dated or restrictions on the Customer Check may have passed (e.g., the check states that it is not responsible for valid after 30 days). If you would like the stop payment requests received for items order to remain in effect after the six-month period or checks that have already cleared or been paid from your account14 day period, then you must renew it. The Bank may provide you notice of the actual Youmay cancel stop payment of a check orders by making such information accessible writing to you online via the SystemBank. Stop payment orders are effective for only six months unless renewed by you prior to expiration automatically canceled when the Account on which the Customer Check is drawn is closed or at the end of the original order. From time to time, the Stop Payment Service may be inoperable. If that occurs, your request can be communicated to the Bank by calling Customer Service at (000) 000-0000. You agree to indemnify the Bank against any loss for the amount of said check and all expenses, costs and consequential damages, if any, incurred by the Bank because of refusing payment pursuant to your stop payment order. You agree not to hold the Bank liable on account of payment contrary to your stop payment order if same occurs through inadvertence, accident six month term or oversight, or if by reason of such payment other items drawn by you are returned insufficient.
