You agree to cooperate with us in any legal actions that we may take against these parties. State law may permit other limitations on our obligation to stop payments.

Stop Payments. This section addresses stop payment requests for Checks drawn on your Account. (It does not apply to Cashier’s Checks.) We may accept a request If you want to stop payment on a Check from any Account holder or Authorized Signer. A check you have written, you must place a written stop payment order at the branch office which holds the account before it is finally paid by us. Any authorized signer on the account may furnish a stop payment order. For example, a joint account holder and one authorized signer may request a stop payment on an item which requires two signatures, regardless of whether that authorized signer's signature was one of the two signatures appearing on the item. You must furnish us with the date, the check number, and the exact amount (dollars and cents) of the check and the name of the payee for us to stop payment on the item. If you provide us with any incorrect information, we will not be effective unless it complies with this section and responsible for our failure to stop payment on the check. We will not be responsible for a stop payment order if we do not have a reasonable opportunity to act on it before final payment of the request and verify that the Check has not been paiditem. If you generate your own checks using a request computer or in any other manner which does not produce a magnetically-encoded check number on the check, we will be unable to stop payment on a Check from any Account holder or Authorized Signer. A guarantee that your stop payment request will not be effective unless it complies honored. You therefore agree to indemnify and hold us harmless should we be unable to honor a stop payment order which you have timely and correctly placed on a check with this section and no magnetically- encoded check number. You must give us sufficient notice of your stop payment request so that we have a reasonable opportunity to act on the your request. Your stop payment request and will only be considered effective once we have had a reasonable opportunity to verify that the Check check has not been paid. Stop Payments. This section addresses  You may place a stop payment, utilizing CeB, on any check that you have written. If you do, you agree to the following terms and conditions: o The information on the stop payment requests for Checks drawn on your Account. (It does not apply to Cashier’s Checks.) Rules for stopping electronic fund transfers, such as ACH payments, are addressed in must precisely identify the Electronic Funds Transfers section of this Account Agreement and our online banking agreement with you. We may accept a request to stop payment on a Check from any Account holder or Authorized Signer. You agree that you will defend the Bank and will be responsible to pay the Stop Payment Fee listed in Bank if any claim or demand of whatever nature, is made against the Fee Schedule for Consumer Accounts for each Bank with respect to a stop payment requestorder and/or the check itself. You agree to indemnify and defend the Bank and to reimburse the Bank for any damages reasonable costs, expenses or expenses, including attorneys’ fees, we attorney’s fees that the Bank may incur due in defending itself against any such claims or demands. Stop Payments. This section addresses You may ask us not to pay any preauthorized electronic transfer or check you have written from an Account of yours (each, a “Transaction”), except if they payment is in the form of a certified check, managers check, or any other check that is governed by a check guarantee agreement, within at least three (3) Business Days before the schedule date of the transfer. Such requests may only be submitted in written form and through a BIBTC Stop Payment Request Form. All stop payment requests must be made to an authorized BIBTC employee by an Authorized Signatory. You must give us the name of the payee and the exact date, number and amount of any Transaction you ask us not to pay. You must also give us any other information we request in order for Checks drawn us to identify you and the stopped Transaction, and we must receive the request in a time and way that gives us a reasonable opportunity to act on it. If you fail to do so, we will have no liability for failure to honor your stop-payment request. Written stop-payment requests are valid for six (6) months and may be renewed in writing any number of times. Stop Payments. For us to be able to enter a stop payment, you must tell us the exact amount of the check (dollars and cents), the check number, date of check, payee and the full account number on which it is drawn. If the information you give us is not correct or if you do not give us other reasonable information requested about the check, we will not be responsible if we are addressed in not able to affect the Electronic Funds Transfers section of this Account Agreement and our online banking agreement with youstop payment. We may accept also cannot be responsible if we are not able to identify the proper check because you have issued more than one check with the same serial number. If you generate your own checks using a request computer or in any other manner which does not produce a magnetically-encoded check number on the check, we will be unable to stop payment on a Check from any Account holder or Authorized Signer. A guarantee that your stop payment request will not be effective unless it complies honored. You therefore agree to indemnify and hold us harmless should we be unable to honor a stop payment order which you have timely and correctly placed on a check with this section and no magnetically-encoded check number. You must give us sufficient notice of your stop payment request so that we have a reasonable opportunity to act on the your request. A When the stop payment request order expires, we may only pay the item and have no duty to notify you except for identifying the item as paid on your statement. You agree that you will be released by the person who requested the responsible to us if any claim or demand is made against us as a result of having acted in accordance with your stop paymentpayment order. You agree to pay the Stop Payment Fee listed in the Fee Schedule for Consumer Accounts for each stop payment request. You agree to indemnify the Bank reimburse us for any damages reasonable costs, expenses or expenses, including attorneys’ fees, we incur due to your stop payment request. You assign to us all rights against the payee or any other holder of the Check. You agree to notify the Bank promptly if a duplicate check is issued or the original is returned. You agree to cooperate with us in any legal actions attorney’s fees that we may take incur in defending ourselves against these partiesany such claims or demands. State law may permit other limitations We are not required to accept a stop payment on a cashier’s check, teller’s check (“official check”), or certified check, unless you provide us with a sworn statement – in a form we deem acceptable – that the check is lost, stolen, or destroyed. After a stop payment is placed, we are not required to refund the money used to purchase the check, or issue a replacement check, until and unless the check is not presented for payment within 90 days after the issue or certification date. If in our obligation discretion we agree to stop paymentsrefund or replace the check, we will require that you purchase a surety bond for the amount of the check.
