Sub-committee on Technical Barriers to Trade. 1. The Parties establish a Sub-committee on Technical Barriers to Trade, comprising representatives of each Party. 2. The Sub-committee shall: (a) follow up and evaluate the implementation and adminis tration of, and compliance with, this Chapter; (b) address adequately any issue that a Party raises relating to this Chapter and the TBT Agreement; (c) contribute to the identification of priorities on cooperation matters and the technical assistance programmes in the area of standards, technical regulations, conformity assessment procedures, accreditation, metrology, border control and market surveillance and examine the progress or results obtained; (d) exchange information on the work carried out in non- governmental, regional and multilateral fora involved in activities relating to standards, technical regulations and conformity assessment procedures; (e) upon request of a Party, consult on any matter arising under this Chapter and the TBT Agreement; (f) establish, when required to achieve the objectives of this Chapter, working groups to deal with specific matters relating to this Chapter and TBT Agreement, clearly defining the scope and responsibilities of those working groups; (g) facilitate, as appropriate, dialogue and cooperation between the regulators in accordance with this Chapter; (h) pursuant to Article 75 subparagraph 1(b) of this Chapter, draw up a work programme in matters of mutual interest to the Parties, which shall be revised periodically; (i) explore all other matters relating to this Chapter which may help to improve access to the markets of the Parties; (j) revise this Chapter in light of any developments under the TBT Agreement and of the decisions or recommendations of the WTO Committee on Technical Barriers to Trade, and make suggestions on possible amendments to this Chapter; (k) inform, if deemed appropriate, the Trade Committee about the implementation of this Chapter; and (l) take any other action which the Parties consider would assist them in the implementation of this Chapter and of the TBT Agreement and in facilitating trade.

(e) enhance co-operation in the development and improvement of standards, technical regulations, and conformity assessment procedures; including the exchange of information between the relevant public or private bodies working on these matters and encourage direct interaction between non- governmental actors, such as standard bodies, accreditators and certifiers;
(f) facilitate the exchange of information about the work carried out being done in non- governmental, regional and multilateral fora involved engaged in activities relating related to standardstechnical regulations, technical regulations standardisation and conformity assessment procedures;
(eg) upon request of a Party, consult on any matter arising under this Chapter and explore ways to facilitate trade between the TBT AgreementParties;
(fh) establish, when required to achieve report on the objectives co-operation programs established under Article 57 of Title VI (Economic and Trade Development) of Part III of this Chapter, working groups to deal with specific matters relating to this Chapter and TBT Agreement, clearly defining their achievements and the scope impact of these projects in facilitating trade and responsibilities in implementing the provisions of those working groups;
(g) facilitate, as appropriate, dialogue and cooperation between the regulators in accordance with this Chapter;
(h) pursuant to Article 75 subparagraph 1(b) of this Chapter, draw up a work programme in matters of mutual interest to the Parties, which shall be revised periodically;
(i) explore all other matters relating to this Chapter which may help to improve access to the markets of the Parties;
(j) revise review this Chapter in the light of any developments under the TBT Agreement and Agreement;
(j) report to the Association Committee on the implementation of the decisions or recommendations provisions of this Chapter, in particular the advances in the fulfilment of the WTO Committee on Technical Barriers goals established and the provisions related to Trade, special and make suggestions on possible amendments to differential treatment;
(k) take any other steps the Parties consider will assist them in implementing this Chapter;
(kl) informestablish dialogues between regulators in accordance with Article 134 (a) of this Chapter and, if deemed where appropriate, working groups to discuss different topics of interest to the Trade Committee about the implementation of this ChapterParties. The working groups may include or consult with non-governmental experts and stakeholders; and
(lm) take any other action which issue instructed by the Parties consider would assist them in the implementation of this Chapter and of the TBT Agreement and in facilitating tradeAssociation Committee.

3. To facilitate the implementation of this Chapter, the representative of each Party in the Sub- committee shall be responsible for coordinating with the institutions of the central government, local public institutions, non-governmental institutions and appropriate persons in the territory of such Party; and, upon request of another Party, invite them to take part in the meetings of the Sub-committee. The representative of the Parties shall communicate on any matter relating to this Chapter.
4. Unless the Parties agree otherwise, the consultations pursuant to subparagraph 2(e) shall constitute consultations under Article 301, provided they fulfil the requirements established in paragraph 9 of that Article.
5. The Sub-committee may meet in sessions where the EU Party and one signatory Andean Country participate, regarding matters which relate exclusively to the bilateral relationship between the EU Party and such signatory Andean Country. If another signatory Andean Country expresses interest in the matter to be discussed in such session, it may participate in the session subject to prior agreement of the EU Party and the signatory Andean Country concerned.
6. Unless the Parties agree otherwise, the Sub-committee shall meet at least once a year. Meetings may be held in person, or by other means agreed by the Parties.

(f) establish, when required to achieve the objectives of this Chapter, working groups to deal with specific matters relating to this Chapter and TBT Agreement, clearly defining the scope and responsibilities of those working groups;
(g) facilitate, as where appropriate, dialogue facilitating sectorial cooperation among governmental and cooperation between non-governmental conformity assessment bodies in the regulators in accordance with this Chapter;
(h) pursuant to Article 75 subparagraph 1(b) of this Chapter, draw up a work programme in matters of mutual interest to the Parties, which shall be revised periodically;
(i) explore all other matters relating to this Chapter which may help to improve access to the markets territory of the Parties;
(je) revise exchanging information on developments in non-governmental, regional, and multilateral fora engaged in activities related to standardisation, technical regulations, and conformity assessment procedures;
(f) taking any other steps the Parties consider may assist them in implementing the TBT Agreement and in facilitating trade in goods between them;
(g) reviewing this Chapter in light of any developments under the TBT Agreement and of the decisions or recommendations of the WTO Committee on Technical Barriers to TradeAgreement, and make suggestions on possible developing recommendations for amendments to this Chapter;Chapter in light of those developments; and
(kh) inform, if deemed as it considers appropriate, reporting to the Committee on Trade Committee about in Goods on the implementation of this Chapter; and.
(l) take 3. Unless agreed otherwise by the Parties, the Sub-Committee on TBT shall meet annually in person, via teleconference, video conference, or through any other action which means as mutually determined by the Parties.
4. The terms of reference of the Sub-Committee shall be determined in its first meeting.
5. The Sub-Committee on TBT shall comprise the contact points, referred to in Article 7.14 and any other Government officials that the Parties consider would assist them in the implementation of this Chapter and of the TBT Agreement and in facilitating tradeappropriate.
