Sub-Quality Gas Sample Clauses

Sub-Quality Gas. Whenever the quality of the Gas delivered by Owner hereunder does not conform to the quality specifications contained herein, Gatherer shall have the night, upon notice to Owner, to: (i) discontinue or cur-tail Gatherer's receipt of Owner's Gas hereunder, or (ii) condition such off specification Gas and charge Owner a competitive rate for such conditioning; provided, however, that Gatherer shall not unduly discriminate against Owner with respect to curtailment or conditioning as compared to other parties on Gatherer's System which are similarly situated on the same segment of Gatherer's System. In the event Gatherer elects not to condition Owner's Gas or in the event the rate at which Gatherer proposes to condition such Gas is not competitive then, and in either such event, Owner shall have the option to condition such Gas to make it conform to the quality specifications of this Agreement; provided, however, if Owner elects to condition its Gas, nothing contained in this Agreement shall obligate Gatherer to pay for any such conditioning. If neither Gatherer nor Owner treats Gas produced from a well(s) which does not conform to the quality specifications of this Agreement and Gatherer chooses not to accept such Gas, then at the written request of Owner, Gatherer shall release from the provisions of this Agreement up to 1600 acres (comprised of up to ten ▇▇▇▇▇ on 160-acre spacing or twenty ▇▇▇▇▇ on 80-acre spacing, as the case may be) actually connected to the Pod which is producing off specification Gas.
Sub-Quality Gas. Gathering System Owners shall have the right, upon notice to Shipper, to discontinue or curtail receipt of Shipper’s Gas hereunder whenever Shipper’s Gas does not conform to the quality specifications in this Article 8, including Gas containing heavy-end liquid hydrocarbon compounds, including ethane, such that the Gas cannot be processed by the Rogersville Plant (as defined in the Gas Purchase Contract) to yield residual gas that conforms to the maximum Btu specification set forth in the East Tennessee Tariff or that is otherwise acceptable for receipt and transportation by such pipeline. Shipper shall have the option to condition or treat such non-conforming Gas to make it conform to the quality specifications of this Agreement, at Shipper’s cost.
Sub-Quality Gas. All gas delivered hereunder shall be of merchantable quality and shall meet the quality specifications set forth in this Article. In the event that gas tendered for delivery hereunder is not of merchantable quality or does not meet the quality specifications of this Contract, Buyer, at its sole option, may at any time: (a) refuse to accept any or all gas; or (b) accept such gas after treatment by Buyer, notify Sellers as soon as practicable thereafter of such acceptance and treatment, and charge a reasonable additional fee to cover the actual costs incurred by Buyer for treatment of such sub-quality gas. Acceptance of any or all gas that fails to conform to the quality specifications of this Contract shall not be deemed a waiver of Sellers’ obligations hereunder with respect to such non-conforming gas or with respect to any future deliveries of sub-quality gas. In the event Buyer rejects delivery of gas for any reason other than sub-quality gas, Buyer shall notify Sellers of its election. Upon receipt of such notice from Buyer, Sellers reserves the option and right to terminate the Contract by giving Buyer thirty (30) days advance written notice. In the event that Sellers’ Gas becomes Sub-Quality Gas, Buyer will use reasonable efforts including time to work with the Sellers in order to bring Gas back to merchantable quality.

  • Quality Assurance/Quality Control Contractor shall establish and maintain a quality assurance/quality control program which shall include procedures for continuous control of all construction and comprehensive inspection and testing of all items of Work, including any Work performed by Subcontractors, so as to ensure complete conformance to the Contract with respect to materials, workmanship, construction, finish, functional performance, and identification. The program established by Contractor shall comply with any quality assurance/quality control requirements incorporated in the Contract.

  • EMHS Governance, Safety and Quality Requirements 4.1 Participates in the maintenance of a safe work environment. 4.2 Actively participates in the Peak Performance program. 4.3 Supports the delivery of safe patient care and the consumers’ experience including participation in continuous quality improvement activities in accordance with the requirements of the National Safety and Quality Health Service Standards and other recognised health standards. 4.4 Completes mandatory training (including safety and quality training) as relevant to role. 4.5 Performs duties in accordance with the EMHS Vision and Values, WA Health Code of Conduct, Occupational Safety and Health legislation, the Disability Services Act and the Equal Opportunity Act and Government, WA Health, EMHS and Departmental / Program specific policies and procedures.

  • SMHS Governance, Safety and Quality Requirements 4.1 Participates in the maintenance of a safe work environment. 4.2 Participates in an annual performance development review. 4.3 Supports the delivery of safe patient care and the consumers’ experience including participation in continuous quality improvement activities in accordance with the requirements of the National Safety and Quality Health Service Standards and other recognised health standards. 4.4 Completes mandatory training (including safety and quality training) as relevant to role. 4.5 Performs duties in accordance with Government, WA Health, South Metropolitan Health Service and Departmental / Program specific policies and procedures. 4.6 Abides by the WA Health Code of Conduct, Occupational Safety and Health legislation, the Disability Services Act and the Equal Opportunity Act.

  • NMHS Governance, Safety and Quality Requirements 2.1 Participates in the maintenance of a safe work environment. 2.2 Participates in an annual performance development review. 2.3 Supports the delivery of safe patient care and the consumers’ experience including participation in continuous quality improvement activities in accordance with the requirements of the National Safety and Quality Health Service Standards and other recognised health standards. 2.4 Completes mandatory training (including safety and quality training) as relevant to role. 2.5 Performs duties in accordance with Government, WA Health, North Metropolitan Health Service and Departmental / Program specific policies and procedures. 2.6 Abides by the WA Health Code of Conduct, Occupational Safety and Health legislation, the Disability Services Act and the Equal Opportunity Act.

  • COUNTY’S QUALITY ASSURANCE PLAN The County or its agent will evaluate the Contractor’s performance under this Contract on not less than an annual basis. Such evaluation will include assessing the Contractor’s compliance with all Contract terms and conditions and performance standards. Contractor deficiencies which the County determines are severe or continuing and that may place performance of the Contract in jeopardy if not corrected will be reported to the Board of Supervisors. The report will include improvement/corrective action measures taken by the County and the Contractor. If improvement does not occur consistent with the corrective action measures, the County may terminate this Contract or impose other penalties as specified in this Contract.
