Common use of SUBMISSION OF PROPOSALS Clause in Contracts

SUBMISSION OF PROPOSALS. (1) The Company shall on or before 30 June 1994 (or by such extended date as the Minister may allow pursuant to clause 23) and subject to the EP Act and the Environmental Approval and the provisions of this Agreement submit to the Minister to the fullest extent reasonably practicable its detailed proposals for the carrying out of the Project, which proposals shall include the location, area, layout, design, materials, time programme for the commencement and completion of construction or the provision (as the case may be) of all things necessary to complete the Project, the order in which the works necessary to complete the Project are to be carried out, and full plans and specifications for all works required to complete the Project. (2) The provisions of clause 22 do not apply to subclause (1). (3) The Company may submit separate proposals for each part of the works necessary to complete the Project, and subject to subclause (4) the Company may carry out each part of the works necessary to complete the Project in such order as the Company sees fit. (4) At the time when the Company submits the first of its proposals pursuant to subclause (1), it shall also furnish to the Minister evidence demonstrating β€” (a) the availability of finance necessary for the carrying out and completion of the whole of the Project; and (b) the readiness of the Company to embark upon and proceed to carry out the operations referred to in those proposals.
