Common use of Subpoena Fees Clause in Contracts

Subpoena Fees. 1. An employee shall retain any subpoena/witness fee received if he is subpoenaed to appear/testify for an administrative, deposition or court hearing and is not paid by the City for the total hours of his appearance. 2. An employee shall not retain any subpoena/witness fee if he receives pay from the City for the total hours of his appearance, and such employee shall return any subpoena/witness fee to the City within five (5) days of receipt.
