Common use of Subpoenas Clause in Contracts

Subpoenas. If a Party receives a subpoena for information concerning a Customer the Party knows to be a Customer of the other Party, it shall refer the subpoena to the requesting party with an indication that the other Party is the responsible company, unless the subpoena requests records for a period of time during which the receiving Party was the Customer's service provider, in which case that Party will respond to any valid request.

If a Party party receives a subpoena for information concerning a Customer an end user the Party party knows or determines to be a Customer subscriber of the other Partyparty, it shall refer promptly inform the subpoena to the requesting party with an indication issuing law enforcement official or agency that the other Party party is the responsible company, unless the subpoena requests records for a period of time during which the receiving Party party was the Customer's subscriber’s service provider, in which case that Party the party will respond to any valid requestsubpoena.
