Common use of Substantial Costs to Developer Clause in Contracts

Substantial Costs to Developer. Developer has incurred and will incur substantial costs in order to comply with conditions of approval of the Entitlements and to assure development of the Property in accordance with the Entitlements and the terms of this Agreement.

Substantial Costs to Developer. Developer has incurred and will incur substantial costs in order to comply with conditions of approval of the Entitlements Project Approvals and to construct the additional infrastructure improvements requested by the City to assure development of the Property Project Site in accordance with the Entitlements and the terms of this Agreement.
