SUBSTITUTION AFTER CONTRACT AWARD. Subject to the Contracting Officer’s determination, material, equipment, article or system with a Variant Feature(s) may be allowed as a substitution, provided it is in the Department’s best interest. The Department may deny a substitution; and if a substitution is denied, the Design-Builder is not entitled to any additional compensation or time extension.

  • Contract Award Award shall be made on a lump sum basis to the lowest responsive and responsible bidder.
