Common use of Sufficiency of Earnings Clause in Contracts

Sufficiency of Earnings. The employee's earnings must be sufficient to cover the amount of the deductions herein authorized after all other required deductions are made. When an employee is in a non-pay status for an entire pay period, no withholdings will be made to cover that pay period from future earnings, nor will the employee deposit the amount which would have been withheld with the City if the employee had been in pay status during that period. In the case of any employee who is in a non-pay status during a part of the pay period, and the salary is not sufficient to cover the full withholding, no deduction shall be made. In this connection, all other required deductions have priority over the Union dues deduction.
