Opinion of Probable Cost. Any opinions of probable Project cost or probable construction cost provided by Engineer are made on the basis of information available to Engineer and on the basis of Engineer’s experience and qualifications and represents its judgment as an experienced and qualified professional engineer. However, since Engineer has no control over the cost of labor, materials, equipment or services furnished by others, or over the contractor(s’) methods of determining prices, or over competitive bidding or market conditions, Engineer does not guarantee that proposals, bids or actual Project or construction cost will not vary from opinions of probable cost Engineer prepares.

Since Xxxxxx has no control over the cost of labor, materials, equipment or services furnished by others, or over the contractor(s)' methods of determining prices, or over competitive bidding or market conditions, Xxxxxx'x Opinion of Probable Cost provided for herein is made on the basis of Xxxxxx'x experience and qualifications and represent Xxxxxx'x best judgment as an experienced and qualified professional engineer, familiar with the construction industry. Client acknowledges and agrees that Xxxxxx cannot and does not guarantee proposals or bids and that actual total Project(s) or construction costs may reasonably vary from Xxxxxx’x Opinion of Probable Cost. If prior to the bidding or negotiating phase Client wishes greater assurance as to total Project(s) or construction costs, Client shall employ an independent cost estimator as provided in paragraph 3.4.3. If Xxxxxx’x Opinion of Probable Cost was performed in accordance with its standard of care and was reasonable under the total circumstances, any services performed by Xxxxxx to modify the contract documents to bring the construction cost within any limitation established by Client will be considered Optional Additional Services and paid for as such by Client. If, however, Xxxxxx’x Opinion of Probable Cost was not performed in accordance with its standard of care and was unreasonable under the total circumstances and the lowest negotiated bid for construction of the Project(s) unreasonably exceeds Xxxxxx'x Opinion of Probable Cost, Xxxxxx shall modify its work as necessary to adjust the Project(s)’ size, and/or quality to reasonably comply with the Client’s budget at no additional cost to Client. Under such circumstances, Xxxxxx’x modification of its work at no cost shall be the limit of Xxxxxx’x responsibility with regard to any unreasonable Opinion of Probable Cost.

However, since A/E has no control over the cost of labor, materials, equipment or services furnished by others, or over the contractor(s’) methods of determining prices, or over competitive bidding or market conditions, A/E does not guarantee that proposals, bids or actual Project or construction cost will not vary from opinions of probable cost A/E prepares.
Opinion of Probable Cost. As a design professional practicing in El Paso the Consultant is expected to be familiar with the cost of construction, labor, and materials in the El Paso area and of bidding and market trends. The cost opinions of construction cost provided by the Consultant, as required herein, are to be made in light of such familiarity and are expected to be within ten percent (10%) of the bid for the base bid item expected from the lowest responsible bidder. The Consultant’s final cost opinions for the construction of the Project, shall take into account labor costs which shall be based on the current City of El Paso prevailing wage rates as adopted by the City Council. In the event that the Project is funded with federal funds, the higher of the City of El Paso prevailing wage rates or the Xxxxx-Xxxxx wage rates shall be utilized by the Consultant in compiling a final cost opinions for the Project. If the Consultant’s most recent cost opinion for any construction contract is in excess of the Project construction budget, the Owner shall give written approval of an increase in the limit, or shall cooperate in revising the Project’s scope or quality, or both, to reduce the cost as required. Such revisions shall be made, and Drawings and Specifications modified by the Consultant without further compensation. As noted herein, if all responsible bids exceed the final cost opinion by more than ten percent (10%), the Consultant agrees, at the direction of the Owner, to redesign the Project without additional charge to the Owner in order to bring the Project within the budgetary limitations.
Opinion of Probable Cost. The ENGINEER will prepare an opinion of probable cost for the project based upon the complete detail design documents.

Opinion of Probable Cost. An opinion of probable cost will be prepared with each deliverable during the design phase. Tetra Tech will provide public engagement services during the design phase of the project. These services will include: • A public engagement action plan; • Clear and concise project description including theme, mission, goals, benefits, challenges and timeline; • Consistent project description messages applicable for use on stakeholder web sites and social media; • Timely updated messages as required; • Messages targeted for specific groups impacted by the projects including MSU staff and students, businesses and residents; • Project contact information (emergency numbers, contact persons, email, etc.), updated as needed; • Timely responses to stakeholder group questions; • A PowerPoint presentation available foruse at meetings, public forums and other presentations regarding the project. • Templates for newsletters, press releases and other print communications for the project. • Creation of materials designed specifically for MSU students. The communications pieces developed during the design phase may include (but not be limited to): • Scheduled social media updates/posts • Tri-fold brochure outlining project details • Door hangers • Direct mail pieces • Project map • Sequence of construction • Digital marketing advertisements Conduct a maximum of three community forums for each stakeholder group (MSU students/faculty/staff, residents and businesses) for a maximum total of nine forums. Each group would have an initial kickoff meeting to introduce the project. A second meeting would be held right before construction contract bidding to remind the groups of the upcoming project. The third meeting with each group would be held right before construction to present the final construction schedule and details, answer questions and give the contact information for the construction phase of the project. These services will be continued as appropriate during Task VI, Construction Services.
