Suits by Trustees on Behalf of Employees. In addition to the right herein granted to the Trustees to file legal action on behalf of the Funds for the collection of any contributions and/or other amounts due and owing by any Employer, the Trustees shall be entitled to and may file legal action on behalf of an eligible employee who has been deprived of accrued benefits by reason of the failure of any Employer to make payments to the funds, as herein required, for such accrued benefits. If by any such action plaintiff is sustained, then in addition to the payment of the accrued benefits to which such employee is entitled or the Funds may be entitled, together with the legal rate of interest, the Employer shall also be liable to pay all costs of suit or suits and reasonable accountant's and attorney's fees.
