Supervisors or Non-Unit Not to Work. The Employer agrees that supervisors or non-unit personnel shall not be used at any time to displace employees regularly employed in the bargaining unit, except in emergencies when Union employees are not available or have refused to do the work as assigned except in cases where unsafe conditions are being charged. It is not the intent of this Section to cause direct layoffs of any bargaining unit employee, or cause the direct reduction in any bargaining unit employee’s scheduled work hours. A good faith attempt to secure bargaining unit personnel will meet the requirements of availability. Note: The definition of an emergency is: “An Emergency” is an unforeseen circumstance or a combination of circumstances which call for immediate action in a situation which is not expected to be of a recurring nature.
