Supplemental Termination Provisions. In addition to our termination rights in Smart Safe Deposits Section , we may immediately terminate your use of the Smart Safe Deposit Services in the event: (a) you breach, or permit the breach of, the security of the Safe; (b) we determine that you have failed to maintain a financial condition that we deem to be reasonably satisfactory to minimize any credit or other risks to us in providing the Smart Safe Deposit Services or we deem immediate termination to be necessary or appropriate to prevent a financial loss to us; (c) you breach any provision of this Agreement; and (d) we, in our sole discretion, determine if provisional credit is no longer feasible or desirable for us to continue to offer. Bags delivered by the Courier on a business day after applicable cut-off hours, or to Credit Union or Provider on a day when Credit Union or Provider, respectfully, is not regularly open for business, need not be opened, verified, or credited by Credit Union or Provider until the following business day. Member shall maintain a complete record of all items placed in the Bag(s) and in the case of loss, to promptly, diligently, and completely cooperate with Credit Union in the identification or replacement of the items so lost. Such cooperation shall include, without limitation, requests by Member to makers of missing checks to issue duplicates, and in the event the makers thereof refuse to do so, then to assert all its legal and equitable rights against said makers or, if applicable, to subrogate such rights to Credit Union or its assigns. The provisions of this paragraph are not intended to alter or modify the responsibility for any loss, shortage or discrepancy set forth in the Service Description. Member acknowledges that, always during the term of the Cash Vault and Deposit Services, it shall be Member’s sole responsibility to purchase and maintain insurance against loss or damage to the contents of Member’s Bags, including Cash, while being handled by the Courier. Credit Union is not and shall not be considered an insurer of any of the deposits or contents placed with the Courier.

  • Early Termination of Agreement This agreement may be terminated at any time upon a thirty (30) day written notice from either party, and without fault or claim for damages by either party.

  • Rescission and Early Termination of Contract The Illinois Commerce Commission is considering rescission and early termination of contract regulations that may afford you opportunities within certain parameters to rescind or terminate your contract without incurring an early termination fee. In addition, your DSP’s tariff (which is on file with the Illinois Commerce Commission) may contain provisions regarding penalty-free rescission periods. Homefield Energy will comply with all applicable provisions and regulations concerning rescission and early termination of contract. Shortly after your election to take service from Homefield Energy, your DSP should provide you an enrollment notice informing you of any rescission rights you may have and the last day for making a request to rescind. If you rescind this Agreement within the timeframe specified by your DSP, your enrollment with Homefield Energy will be cancelled without penalty to you. Upon rescission in accordance with applicable law, this Agreement will be considered cancelled and neither party shall have any further obligation hereunder to each other. If you do not rescind this Agreement, you still may terminate the Agreement without any termination fee or penalty within 10 business days after the date of the first bill issued to you under this Agreement by calling Homefield Energy toll-free at 000-000-0000 to let Homefield Energy know to terminate this Agreement. You may terminate a residential electric supply agreement in this manner only one time in any 12 month period. Upon termination, you will remain responsible for all obligations, including payment for Retail Power and related costs and charges, incurred under this Agreement prior to the effective date of termination, including any applicable termination fee.
