By Member. The Member agrees to repair and maintain his dwelling unit at his own expense as follows:
(1) Any repairs or maintenance necessitated by the member’s negligence or misuse or that of a family member, guest or visitor;
(2) Any decoration of his own dwelling unit; and
(3) Any repairs, maintenance or replacements required on items not furnished by the Corporation
(4) Any repairs or maintenance necessitated by the act of a third party, known or unknown.
By Member. Each Member shall be responsible for the repair and maintenance of their Mobile Home and of their own Space, including removal of debris. The Member shall be responsible for the repair of common area of the Park if:
(a) Any repairs, replacements or maintenance are necessitated by the Member's negligence or misuse, or that of other occupants of the Member's Space, or that of Member's guests or invitees; and
(b) Any repairs, maintenance or replacements are required pursuant to this Occupancy Agreement or the Bylaws.
By Member. Notwithstanding any provision to the contrary contained herein or in the Facility Lease I or Facility Lease II, Member may (without the consent of Lessee) Transfer: (i) less than fifty (50%) percent of its interest in Lessor to any Person; (ii) any of its interest in Lessor to an Affiliate of Member; (iii) any of its interest in Lessor in connection with a public offering or sale of any such interest; and (iv) any of its interest in Lessor to an Affiliate of Parent or to the shareholders of Parent or the shareholders of an Affiliate of Parent in connection with a spin-off (each such transferee, a "Permissible Transferee").
By Member. Member also has a right to terminate this Agreement immediately for convenience by giving University written notice, provided that Member will not be entitled to a refund of any funds already paid to the University.
By Member. The Member agrees to repair and maintain the Premises at Member’s own expense as follows:
(a) Any repairs or maintenance to non-standard items located in or about Member’s Dwelling Unit or other portions of the Premises appurtenant thereto whether installed by Member or previous occupants of the Dwelling Unit; misuse; similar items;
(b) Any repairs or maintenance necessitated by Member’s own negligence or
(c) Minor standard repairs including but not limited to light bulbs, filters and
(d) Any redecoration or modification of the Premises;
(e) Any purchase, installation, repairs, maintenance, Board-approved alterations or modifications of improvements or original fixtures and component parts thereof that were added to the Premises by Member or previous occupants of the Dwelling Unit (whether within the interior of the Unit or exterior to the Dwelling Unit) including added items within the interior surfaces of the perimeter walls, floors and ceiling of the Dwelling Unit; and
(f) Any repairs, maintenance, removal or replacements of nonstandard or relocated construction or fixtures in easements for ingress, egress and support (see Civil Code Section 4505) including, but not limited to, HVAC units, cart pads and walkways.
By Member. The Member shall pay directly to the supplier for electricity, telephone, Internet, natural gas and other utilities not otherwise provided by the Cooperative. The Member shall furnish and maintain at his/her own expense the kitchen range, range hood, refrigerator, dishwasher, electrical and plumbing fixtures inside the dwelling unit and alterations made by the Member.
By Member. Each Member shall indemnify, protect, defend, release and hold harmless the Company, any other Members and such Member's Directors, Affiliates and respective directors, officers, employees and agents from and against any Claims asserted by or on behalf of any Person (including another Member) that arise out of, relate to or are otherwise attributable to, directly or indirectly, a Default by the indemnifying Member or its Affiliates, any Pre-Transfer Liability of the indemnifying Member or its Affiliates or the gross negligence or willful misconduct of the indemnifying Member or its Directors, Affiliates and respective directors, officers, employees and agents in connection with this Agreement.
By Member. Member agrees to promptly undertake and complete, at Member’s sole expense, any and all of the following repairs and/or maintenance on Member’s dwelling unit:
a. Any repairs or maintenance necessitated by negligence or misuse
b. Any redecoration or remodeling
c. Any repair, maintenance or replacement pertaining to the following: cooking range, stove top, oven, refrigerator, garbage disposal, door locks (except Arcadia doors), doorbells, any carpeting or flooring, bathtubs, toilet seats, drapes, fence and gates; and any new room additions, patio covers, or storage sheds, whether added by current member or a previous member.
By Member. 1. The Member shall pay directly to the supplier for telephone, cable, internet service, and other utilities not otherwise provided by the Co-Op.
2. The Member shall furnish all window coverings, shades or interior shutters and any screen doors.
3. The Member shall furnish a copy of the Declaration page of their Tenants Occupancy Insurance Policy annually.
By Member. The Member agrees to repair and maintain his dwelling unit at his own expense as follows:
1. The cost to repair or maintain interior floor coverings, walls & ceilings, light fixtures, plumbing fixtures, electrical fixtures, cabinetry, interior doors, plumbing.
2. The cost to redecorate his own townhome.
3. The cost to repair any water damage to interior floors, walls, ceilings or fixtures arising from the water heater, furnace, air conditioner or other fixture within the townhome.
4. The cost to unstop clogged sewer lines from the townhome to the common trunk line.
5. The cost to repair, maintain or replace items not furnished by the Cooperative.
