Common use of SURVEY MONUMENTS Clause in Contracts

SURVEY MONUMENTS. No land survey monument shall be disturbed or moved until Engineer has been properly notified and the Engineer's surveyor has referenced the survey monument for resetting. The parties agree that upon such an unauthorized disturbance it is difficult to determine the damages from such a disturbance, and the parties agree that Contractor will pay as liquidated damages the sum of $1,000 to cover such damage and expense. Only the Engineer’s licensed surveyor shall reset the monument, and at the Contractor’s sole cost.
