Suspension by Owner. Should the Owner postpone or delay the Project or otherwise suspend performance of this Agreement for a longer period than has been allowed in the Agreement form, the Architect may terminate the Agreement by written notice to the Owner and the Architect shall be paid for Services rendered.

Suspension by Owner. Should the Owner suspend the Work or any part which includes the Subcontract Work and such suspension is not due to any act or omission of the Contractor, or any other person or entity for whose acts or omissions the Contractor may be liable, the Contractor shall notify the Subcontractor in writing and upon receiving notification the Subcontractor shall immediately suspend the Subcontract Work. In the event of Owner suspension, the Contractor's liability to the Subcontractor shall be limited to the extent of the Contractor's recovery on the Subcontractor's behalf under the Subcontract Documents. The Contractor agrees to cooperate with the Subcontractor, at the Subcontractor's expense, in the prosecution of any Subcontractor claim arising out of an Owner suspension and to permit the Subcontractor to prosecute the claim, in the name of the Contractor, for the use and benefit of the Subcontractor.

Suspension by Owner. 8.3.1 The Contracting Officer may order Contractor in writing to suspend, delay or interrupt all or any part of the Work for such period as it may determine to be appropriate for the convenience of Owner. 8.3.2 If the performance of all or any part of the Work on the Project is suspended, delayed, or interrupted at the direction of the Contracting Officer, and such act (i) causes delays in the critical path activity set forth in the CPM Schedule; and (ii) affects any Key Completion Time in Exhibit A, then any such affected Key Completion Time shall be adjusted as determined by the Contracting Officer, but the total extension of any Key Completion Time shall not exceed the length of the delay. 8.3.3 Any claims for extension of time pursuant to Section 8.3.2 shall be made in writing to the Contracting Officer no more than ten (10) Days after the commencement of the delay, otherwise they shall be waived. In the case of a continuing cause of delay, only one claim is necessary. Any delay of less than twenty-four (24) hours’ duration shall not be justification for adjusting any Key Completion Time or the Contract Price. 8.3.4 To the extent practical, Contractor shall reduce the size of its Project staff upon notice from the Contracting Officer of any Owner caused delay or interruption which is likely to exceed thirty (30) Days to reduce costs and expenses to Owner. Upon the termination of the delay or as otherwise directed by Owner, Contractor shall restore the Project staff to its former size. 8.3.5 No adjustments to the Contract Price or Contract Time or any Key Completion Time shall be made under this Section 8.3 for any suspension, delay, or interruption by Owner (i) to the extent that performance would have been so suspended, delayed or interrupted by the fault or negligence of Contractor or any party under Contractor’s responsibility and control or (ii) for which an equitable adjustment is provided or excluded under any other provision of the Contract Documents. Owner’s exercise of any of its rights under the Contract Documents or Owner’s requirement of correction or re-execution of any defective Work shall not, under any circumstances, be construed as interference with Contractor’s performance of the Work. 8.3.6 Notwithstanding anything contained herein to the contrary, no extensions of the Contract Time, any Key Completion Times or increase to the Contract Price shall be permitted except as approved in advance and in accordance with the GLWA Procurement ...
Suspension by Owner. Owner may order Construction Manager to suspend, delay or interrupt the Work, in whole or in part, for any reason and for such period of time as Owner may determine. Upon resumption of the Work, an adjustment shall be made for any reasonable increases in the cost of performance of the Work substantiated by Construction Manager to Owner, including profit on the increased cost of performance resulting from the suspension, delay or interruption ordered by Owner. However, no adjustment shall be made to the extent: (1) that performance is, was or would have been so suspended, delayed or interrupted by another cause for which Construction Manager is responsible; or (2) that an equitable adjustment is made or denied under another provision of the Contract Documents (except as to costs and expenses paid by Construction Manager to its Subcontractors and materialmen).

Suspension by Owner. Owner may suspend the Project at its sole discretion. If the Project is suspended by Owner for more than 30 consecutive days, A/E shall be compensated for services performed prior to the notice of suspension, provided the suspension was not caused by A/E’s negligence or wrongful act. A/E’s compensation shall be equitably adjusted to provide for expenses incurred in the interruption and resumption of A/E’s services. Upon written notice by Owner to resume services, A/E shall promptly continue with its responsibilities under this Agreement. In the event of termination or suspension as provided for above, all construction drawings, sketches, renderings, models, other reproducible drawings, surveys, reports, photographs, calculations, prepared by A/E under this Agreement, copies of all correspondence and papers received or issued by A/E and all equipment and publications authorized by Owner for purchase shall be delivered to Owner upon request and Owner shall have the same rights to their use as if the termination or suspension had not occurred, provided, however, that A/E has been compensated according to this article.

In the event of Owner suspension, CH2M HILL’s liability to Subcontractor shall be limited to the extent of CH2M HILL’s recovery on Subcontractor’s behalf under the Contract Documents.
