Common use of Suspension by Owner Clause in Contracts

Suspension by Owner. Should the Owner suspend its agreement with the Contractor or any part which includes the Subcontract Work, the Contractor shall notify the Subcontractor in writing and upon receiving notification the Subcontractor shall immediately suspend the Subcontract Work. In the event of Owner suspension, the Contractor's liability to the Subcontractor shall be limited to the extent of the Contractor's recovery on the Subcontractor's behalf under the Subcontract Documents. The Contractor agrees to cooperate with the Subcontractor, at the Subcontractor's expense, in the prosecution of any Subcontractor claim arising out of an Owner suspension and, in the Contractor’s sole discretion, to permit the Subcontractor to prosecute the claim, in the name of the Contractor, for the use and benefit of the Subcontractor.

Should the Owner suspend its agreement with the Contractor Prime Contract or any part of the Prime Contract which includes the Subcontract Subcontractor’s Work, the Contractor shall so notify the Subcontractor in writing and upon receiving notification the receipt of said notice Subcontractor shall immediately suspend the Subcontract Subcontractor’s Work. In the event of such Owner suspension, the Contractor's ’s liability to the Subcontractor shall be is limited to the extent of the Contractor's ’s recovery on the Subcontractor's ’s behalf under the Subcontract Contract Documents. The Contractor agrees to cooperate with the Subcontractor, at the Subcontractor's ’s expense, in the prosecution of any Subcontractor claim arising out of an Owner suspension and, in the Contractor’s sole discretion, and to permit the Subcontractor to prosecute the said claim, in the name of the Contractor, for the use and benefit of Subcontractor or, at Contractor’s sole discretion, assign the claim to Subcontractor.
