Swiss Investment Advisers. In accordance with applicable U.S. Treasury Regulations, an entity the sole activity of which is to render investment advice to and act on behalf of a customer (other than a collective investment vehicle, unless such collective investment vehicle is treated as a qualified collective investment vehicle under relevant U.S. Treasury Regulations and no interests in the qualified collective investment vehicle are held through such entity) based on a power of attorney or a similar instrument (e.g. an investment authority) issued by the holder of a Financial Account or based on investment powers in a directorship capacity for the purposes of investing, managing or administering funds deposited in the name of the person or entity granting the power (or issuing the similar instrument) with a Financial Institution other than a Nonparticipating Financial Institution.

The Sub-Advisor may also be authorized, but only to the extent such duties are delegated in writing by the Advisor, to provide additional investment management services to the Portfolio, including but not limited to services such as managing foreign currency investments, purchasing and selling or writing futures and options contracts, borrowing money or lending securities on behalf of the Portfolio. All investment management and any other activities of the Sub-Advisor shall at all times be subject to the control and direction of the Advisor and the Trust's Board of Trustees.

Transactions involving your savings and checking accounts will be subject to the terms of your Membership and Account Agreement. Transactions involving your loan accounts will be subject to your applicable Loan Agreement and Disclosures.

  • Previous Investments This Agreement shall also apply to investments made before its entry into force by investors of one Contracting Party in the territory of the other Contracting Party in accordance with the latter's laws and regulations.
