Common use of Teachers' Rights of Recall Clause in Contracts

Teachers' Rights of Recall. a. When a position on the teaching staff of the District becomes available, the Board shall, subject to Article C.20.3.a.i and C.20.3.a.ii, first offer recall to the teacher who has the most seniority among those laid-off pursuant to this Article, provided that the teacher possesses the necessary qualifications for the available position. If the teacher declines the offer, the position shall be offered to the teacher with the next greatest seniority and the necessary qualifications, and the process shall be repeated until the position is filled. All positions shall be filled in this manner while there are remaining teachers who have been laid-off pursuant to this Article and have not lost recall rights under this Article. A position shall not be required to be offered to the same person more than once.
