TEACHING ASSIGNMENTS AND TRANSFERS. Section 1. Teachers will be notified in writing of any changes of programs from the prior school year, including the schools to which they will be assigned, the grades that they will teach, any departmental transfers, and any special or unusual classes that they will have, not later than June 1. It is recognized that unusual circumstances may dictate the need for involuntary transfers after that date. Teachers who desire a change in grade and/or subject assignment or who desire to transfer to another building shall file a written statement of such desires with the Superintendent, normally not later than June 1. Not any later than July 1, the Superintendent shall notify in writing said teachers of the disposition of their request. The President of the Association will be notified by email of positions that become vacant after the close of school in June. A teacher whose transfer request has not been honored will have the opportunity to meet with the Superintendent, if requested, in order to be informed of the reason(s) why the transfer request was not honored. The wishes of the individual teacher requesting a transfer in this respect will receive the fullest consideration, but the educational requirements of the school system and its pupils will be the controlling factor as decided by the Superintendent without recourse to grievance or arbitration. A major factor in the final decision to make an involuntary transfer shall be the instructional requirements of the School System and its pupils as determined by the Superintendent, but any such involuntary transfer shall be subjected to the grievance and arbitration procedure. 1. The teacher involved must be certified in the shared job.
2. The job sharing request may not exceed one (1) school year. (Teachers may reapply the following year, however.)
3. The job sharing application by the teachers involved is subject to the following procedure:
(a) Principal: Interview, explanation, decision
(b) Superintendent: Interview, explanation, approval
4. The application to job share must be submitted to the Principal by March 11 of the preceding school year.
5. 8. Job sharing teachers may be made required to limit team teach up to the first eight (8) teaching days of the school year. The job sharing teachers and their Administrator shall meet to discuss this issue in the attempt to arrive at a mutual agreement as to the amount of inter-school traveldays. 3. Teachers will not be assigned, except for good cause at the discretion of administration (in consultation with the teacher involved), outside the scope of their teaching licenses and in no event more than allowed by law. The Superintendent and administration shall maintain the right to assign staff to the various educational sites for the school year based on educational program needs.
4. Teachers shall be notified of their assignments and location, and of any involuntary changes in their assignment, for the ensuing school year by the 30th of April, except for those instances in which such assignments cannot be made by the Superintendent until after said date. All such assignments shall be subject to changes after the 30th of April if the Superintendent deems such regulations a change to be necessary or desirable; but the Superintendent will exert every effort to avoid or minimize any such changes.
5. The administration reserves the right to transfer teachers as may necessary. The first step will be issued by to seek qualified volunteers. If no qualified teacher volunteers for transfer and/or the volunteer is not selected, the Administration shall make decisions regarding transfer according to what is best for the school, taking into consideration the following factors:
a. Teacher qualifications and credentials,
b. Teacher preferences,
c. Level of disruption for students and the school,
d. Number of involuntary transfers a teacher has made, and
e. Whether the transfer involves a change of building location.
6. When two or more teachers apply for a particular position, then administration concerning shall choose the submission of voucherssuccessful applicant based upon what is best for the school.

Any teacher not reassigned after requesting a change in assignment may request a conference with the Superintendent of Schools or his/her designee concerning his/her request.
4. Teachers will be consulted regarding said involuntarily transferred from building to building only after the following procedure has been followed:
(a) A meeting of all concerned individuals will be held to identify the need and reasons necessitating the transfer. Concerned individuals shall include, but not be limited to, the teachers and administrators involved.
(b) A volunteer will be sought for the transfer. Volunteers will be given serious consideration for the assignment as specified in Article IX, Section B-3.
(c) If no volunteer is forthcoming, the transfer will be made on a seniority basis, if possible, with the least senior being transferred. In addition to seniority, the following criteria may be considered:
1. Area of certification; or
2. area of specialization within certification. For the purpose of this article, seniority shall mean the total continuous District service in a position covered by this collective bargaining agreement, as shown by the Board of Education minutes. Such service shall include all Regular Substitute teaching service. All paid leaves of absence shall be included in the computation of total continuous District service at full credit.
(d) If the District finds it necessary to make the transfer other than to the person who volunteered or on the basis of seniority, it must furnish the teacher to be transferred and the president of the OCTA detailed reasons for the transfer, in writing, at least thirty (30) days prior to the implementation of the transfer.
Section 5. Teachers' assignments will be made without regard In the event that a new building is constructed in the District, which is a supplement to, rather than a replacement of, existing facilities, and/or grade level reconfiguration is adopted, the committee established under Article IX-B-4 of the 1992-95 collective bargaining agreement, will, at the time that ground is first broken on the new building, and/or grade level reconfiguration is adopted, meet to ageattempt to determine a fair and equitable means of selecting staff.
