TERMINATION OF APPOINTMENT. 23.4.1 The Authority may, in its discretion, terminate the appointment of the Independent Engineer at any time, but only after appointment of another Independent Engineer in accordance with Clause 23.1. 23.4.2 If the Concessionaire has reason to believe that the Independent Engineer is not discharging its duties and functions in a fair, efficient and diligent manner, it may make a written representation to the Authority and seek termination of the appointment of the Independent Engineer. In the event that the appointment of the Independent Engineer is terminated hereunder, the Authority MOR shall appoint forthwith another Independent Engineer in accordance with Clause 23.1.

In the event that the appointment of the Independent Engineer is terminated hereunder, the Authority shall appoint forthwith another Independent Engineer in accordance with Clause 23.1.21.1

In the event that the appointment of the Independent Engineer is terminated hereunder, the Authority Government shall appoint forthwith another Independent Engineer in accordance with Clause 23.1.

In the event that the appointment of the Independent Engineer Expert is terminated hereunder, the Authority shall appoint forthwith another Independent Engineer Expert in accordance with Clause 23.121.1.

In the event that the appointment of the Independent Engineer is terminated hereunder, the Authority shall appoint forthwith another Independent Engineer in accordance with Clause 23.124.1.

In the event that the appointment of the Independent Engineer is terminated hereunder, the Authority shall appoint forthwith another Independent Engineer in accordance with Clause 23.126.1.

TERMINATION OF APPOINTMENT. 23.4.1 (a) The Authority Client may, in its discretion, terminate the appointment of the Independent Engineer at any time, but only after appointment of another Independent Engineer in accordance with Clause 23.1Article 15.1. 23.4.2 (b) If the Concessionaire Developer has reason to believe that the Independent Engineer is not discharging its duties and functions in a fair, efficient and diligent manner, it may make a written representation to the Authority Client and seek termination of the appointment of the Independent Engineer. Upon receipt of such representation, the Authority Client shall hold a tripartite meeting with the Concessionaire Developer and Independent Engineer for an amicable resolution of the Dispute, and if any difference or disagreement between the Authority Client and the Concessionaire Developer remains unresolved, the Dispute shall be settled in accordance with the Dispute Resolution Procedure. In the event that the appointment of the Independent Engineer is terminated hereunder, the Authority Client shall appoint forthwith another Independent Engineer in accordance with Clause 23.1Article 15.1.

In the event that the appointment of the Independent Engineer is terminated hereunder, the Authority shall appoint forthwith another Independent Engineer in accordance with Clause 23.126.1.

Upon receipt of such representation, the Authority shall hold a tripartite meeting with the Concessionaire Mine Operator and the Independent Engineer for an amicable resolution of the Dispute, and if any difference or disagreement between the Authority and the Concessionaire Mine Operator remains unresolved, the Dispute shall be settled in accordance with the Dispute Resolution Procedure. Pending resolution of such Dispute and unless otherwise specified by the Authority, the Independent Engineer shall continue to perform its functions under this Agreement. In the event that the appointment of the Independent Engineer is terminated hereunder, the Authority shall appoint forthwith another Independent Engineer in accordance with Clause 23.126.1.

In the event that the appointment of the Independent Engineer is terminated hereunder, the Authority shall appoint forthwith another Independent Engineer in accordance with Clause 23.117.1.

Pending resolution of such Dispute and unless otherwise specified by the Authority, the Independent Engineer shall continue to perform its functions under this Agreement. In the event that the appointment of the Independent Engineer is terminated hereunder, the Authority shall appoint forthwith another Independent Engineer in accordance with Clause 23.126.1.

Upon receipt of such representation, the Authority shall hold a tripartite meeting with the Concessionaire Project Company and Independent Engineer for an amicable resolution of the Dispute, and if any difference or disagreement between the Authority and the Concessionaire Project Company remains unresolved, the Dispute shall be settled in accordance with the Dispute Resolution Procedure. In the event that the appointment of the Independent Engineer is terminated hereunder, the Authority shall appoint forthwith another Independent Engineer in accordance with Clause 23.111.1.

TERMINATION OF APPOINTMENT. 23.4.1 19.4.1. The Contracting Authority may, in its discretion, terminate the appointment of the Independent Engineer at any time, but only after appointment of another Independent Engineer in accordance with Clause 23.119.1. 23.4.2 19.4.2. If the Concessionaire has reason to believe that the Independent Engineer is not discharging its duties and functions in a fair, efficient and diligent manner, it may make a written representation to the Contracting Authority and seek termination of the appointment of the Independent Engineer. Upon receipt of such representation, the Contracting Authority shall hold a tripartite meeting with the Concessionaire and Independent Engineer for an amicable resolution of the Dispute, and if any difference or disagreement between the Contracting Authority and the Concessionaire remains unresolved, the Dispute shall be settled in accordance with the Dispute Resolution ProcedureProcedure (see Article 33). In the event that the appointment of the Independent Engineer is terminated hereunder, the Contracting Authority shall appoint forthwith another Independent Engineer in accordance with Clause 23.119.1.

The Authority may, in its discretion, terminate the appointment of the Independent Engineer at any time, but only after appointment of another Independent Engineer in accordance with Clause 23.127.1. 23.4.2 27.4.2. If the Concessionaire has reason to believe that the Independent Engineer is not discharging its duties and functions in a fair, efficient and diligent manner, it may make a written representation to the Authority and seek termination of the appointment of the Independent Engineer. Upon receipt of such representation, the Authority shall hold a tripartite meeting with the Concessionaire and Independent Engineer for an amicable resolution of the Dispute, and if any difference or disagreement between the Authority and the Concessionaire remains unresolved, the Dispute shall be settled in accordance with the Dispute Resolution Procedure. In the event that the appointment of the Independent Engineer is terminated hereunder, the Authority shall appoint forthwith another Independent Engineer in accordance with Clause 23.127.1.

In the event that the appointment of the Independent Engineer is terminated hereunder, the Authority shall appoint forthwith another Independent Engineer in accordance with Clause 23.1.

In the event that the appointment of the Independent Engineer is terminated hereunder, the Authority shall appoint forthwith another Independent Engineer in accordance with Clause 23.122.1.
