Termination of Lease for Lack of Appropriations and Authorizations. If, for any fiscal year during the Term, sufficient funds for the discharge of Tenant’s obligations under this Lease are not appropriated and authorized, or if, during any fiscal year during the Term, funds for the discharge of Tenant’s obligations under this Lease are reduced pursuant to X. X. x. 29, § 9C, then Tenant has the right to terminate this Lease by written notice to Landlord without any liability whatsoever for damages, penalties, or other charges arising from early termination, and without further recourse to either party; provided, however, that Tenant must pay all Rent and any other charges due to Landlord for the period before Xxxxxx’s surrender of the Premises, and that Tenant must comply with the provisions of § 6.7 of this Lease.
