Termination Rights on Takings. If the entirety of the Premises are taken by eminent domain, or condemned for public use, or if such portion of the Premises are so taken or condemned such that, in Tenant’s bona fide business judgment, the continued operation of Tenant’s business in the Premises will be materially adversely affected, this Lease may be terminated by Tenant, and thereafter neither party shall have rights or obligation that incur after said termination. If the entirety of the Property is so taken or condemned, or if, prior to the time that Tenant leases the ROFO Premises, such portion of the Property is so taken or condemned, such that, in Landlord’s bona fide business judgment, the continued operation of the Property is uneconomic, this Lease may be terminated by Landlord.
