Common use of Terms of Usage Clause in Contracts

Terms of Usage. Resident and Resident’s guests and invitees shall use the Center only in strict compliance with all rules established by VWA for use of the Center, including all rules posted at the Center, and each of the following (“Rules and Regulations”): a. The Center may be reserved: (i) only by a full time Resident of the VWA subdivision: and (ii) only if all assessments applicable to the lot upon which Resident resides, are paid in full. b. While VWA does employ lifeguards and other personnel to supervise the pool during normal hours of operation, any resident renting the pool must contact Pool Company to make arrangements for additional lifeguards for pool use. This stipulation is regardless of whether or not use is during normal operational hours. All costs for additional lifeguard coverage will be at the expense of the resident renting the pool. c. All parties shall end (I) for children under age of sixteen by 11:00 p.m. and (II) for all others by midnight and all clean up, as set forth in paragraph 3(a), shall be completed within thirty (30) minutes following the end of the party. d. All persons attending the party shall leave the Center (including the adjacent parking lot areas) within thirty minutes following the end of the party. This rule shall apply to any full time Resident of the VWA subdivision if the party ends during regular pool hours. e. Barbecuing, grilling or any other cooking, and use of any glass or other breakable containers or utensils (including bottles, glasses or plates) are, each and all, prohibited outside the confines of the clubhouse room. f. Noise levels, including music, shall be maintained at a level, which is not audible inside any house in the VWA subdivision or a nuisance or annoyance to area residents. g. Nails, bolts and sticky adhesives are not allowed in attaching items to floors, walls and/or ceilings. Any damage caused by such use will be charged to the resident renting the Center. h. Use of the Center for the party is limited to only the date(s) and time(s) set forth above. VWA, its officers, agent or employees, shall be authorized to immediately terminate such use and to require Resident and Resident’s guest(s) to immediately vacate the Center when, in the sole opinion of VWA, its officers, agents or employees, the conduct of any person becomes offensive, noisy, dangerous, or illegal, or is otherwise in violation of any rules and regulations or which infringes upon the rights of adjoining property owners or residents. i. Use of clubhouse and/or pool does not include use of tennis courts. j. Use of Center is restricted to social/recreational use only. No business, whether for profit or not, is allowed.

VWAPLV, its officers, agent or employees, shall be authorized to immediately terminate such use and to require Resident Homeowner and ResidentHomeowner’s guest(s) to immediately vacate the Center when, in the sole opinion of VWAPLV, its officers, agents or employees, the conduct of any person becomes offensive, noisy, dangerous, or illegal, or is otherwise in violation of any rules and regulations or which infringes upon the rights of adjoining property owners or residentsHomeowners. i. k. Use of clubhouse and/or pool does not include use of tennis courts. j. l. Use of Center is restricted to social/recreational use only. No business, whether for profit or not, is allowed. m. Due to the liability and risk on the HOA, BOUNCE HOUSES ARE NOT PERMITTED. No exceptions will be made. n. No tents may be placed on the outside of the property. o. No use of the parking lot other than parking of vehicles. p. All parties with guests under 21 yrs of age must be chaperoned by an adult over 21.

If any noise interferes with the lifeguards’ ability to enforce the safety of the pool area, they will have the authority to request the noise be lowered. g. Nails, bolts bolts, staples and sticky adhesives are not allowed in attaching items to floors, walls and/or ceilings. Any damage caused by such use will be charged to the resident renting the Center. h. Use of the Center for the party is limited to only the date(s) and time(s) set forth above. VWABPCIA, its officers, agent or employees, shall be authorized to immediately terminate such use and to require Resident and Resident’s guest(s) to immediately vacate the Center when, in the sole opinion of VWABPCIA, its officers, agents or employees, the conduct of any person becomes offensive, noisy, dangerous, or illegal, or is otherwise in violation of any rules and regulations or which infringes upon the rights of adjoining property owners or residents. i. Use of clubhouse and/or pool does not include use of tennis courts. j. Use of Center is restricted to social/recreational use only. No business, whether for profit or not, is allowed.

Terms of Usage. Resident and Resident’s their guests and invitees (“Guests”) shall use the Recreational Center only in strict compliance with all the following rules established by VWA for use of the Center, including all and conditions and any additional published or posted rules posted at the Recreational Center, and each of the following (“Rules and Regulations”):: a. The Recreational Center may be reserved: (i) only by a full time permanent Resident of the VWA subdivision: Subdivision; and (ii) only if all assessments applicable to the Resident is in good standing with the Association, including, but not limited to, the lot upon on which the Resident residesresides is not in violation of the Association’s governing documents or rules and regulations, are paid in full.including any b. While VWA does employ lifeguards Rental is arranged for the day of the party only. Approved renters (“Renters”/“Renter”) are not to enter the clubhouse on any other day than the agreed rental date. The clubhouse is equipped with a security alarm and other personnel if police are dispatched due to supervise Renters tripping the pool during normal hours of operation, any resident renting the pool must contact Pool Company to make arrangements for additional lifeguards for pool use. This stipulation is regardless of whether or not use is during normal operational hours. This rule shall apply to any full time Resident of the VWA subdivision if the party ends during regular pool hours. e. Barbecuing, grilling or any other cooking, and use of any glass or other breakable containers or utensils (including bottles, glasses or plates) are, each and all, prohibited NO GLASS shall be permitted outside the confines of the clubhouse roomclubhouse. f. Barbecuing or grilling is only allowed a safe distance away from the clubhouse and never allowed under the covered patio areas. g. Noise levels, including music, shall be maintained at a level, level which is not audible detectable inside any house residence in the VWA subdivision Subdivision or become a nuisance or annoyance to area residentsthe surrounding homes. g. h. Nails, bolts and screws, sticky adhesives adhesives, tape or fasteners of any kind are not allowed in attaching allowed. Attachment of items to floors, walls and/or ceilingsceilings is prohibited. Any damage caused by such use will be charged to the resident renting Renter and/or to the Centerproperty account of the residence affiliated with the Renter, as the case may be. h. i. Stove is provided for the convenience of reheating items prepared elsewhere. Onsite cooking is prohibited. j. Use of the Recreational Center for the party is limited to only the date(s) and time(s) set forth abovereserved by the Renter and agreed upon by the Association. VWA, its officers, agent or employees, The Association has the absolute right and shall be authorized to immediately revoke and terminate such the Renter’s use and to require Resident and Resident’s guest(s) to immediately vacate of the Center whenRecreational Center, if in the sole opinion of VWA, its officers, agents or employeesAssociation’s business judgment, the conduct of any person party or activity becomes offensive, noisyloud, dangerous, or illegal, or is otherwise in violation of any rules and regulations or which infringes upon the rights of adjoining property owners or residents. Such right to revoke and terminate the Renter’s use is absolute, and the Association shall not be liable to the Renter for any costs or expenses associated with the party, whether foreseeable or not. i. k. Use of clubhouse and/or pool Recreational Center does not include use of the tennis courts. j. l. Rental of the Recreational Center does not imply exclusivity nor prohibit other residents from use of the pool during regular pool hours. m. Use of Recreational Center is restricted to social/recreational use functions only. No business, whether for profit or not, is allowed. n. Renters and their Guests assume all risks, including those risks suffered by or associated with their use of the Recreational Areas, including, but not limited to, bodily injury and damage, loss or theft to property. o. Renters and their Guests are responsible for their own safety and the safety of their minor children and minor Guests, and the Association is not responsible for the health and safety of participants in the Recreational Areas.
