Territory Boundary. (a) As a condition precedent to the execution of this Master Agreement, the Parties have negotiated an electric service territory boundary (“Territory Boundary”), as shown on the map in Attachment A to this Master Agreement (the “Boundary Map”). Attachment B is a legal description of the Territory Boundary, and Attachment C is a plat map defining the Territory Boundary. In the event of a conflict between the map of Attachment A and the legal description of Attachment B, the map of Attachment A shall control. (b) Subject to this Master Agreement, Municipal Utility shall have the exclusive right to provide electric service to all premises located inside the area delineated by the Territory Boundary. (c) Subject to this Master Agreement, WPL shall have the exclusive right to provide electric service to all premises located outside the area delineated by the Territory Boundary. Municipal Utility shall not extend service to any new premises outside the Territory Boundary without first obtaining WPL's written consent. (d) Either Party, where necessary, may extend a distribution line that passes through the other Party's service territory provided that no premises are served from that line in violation of the other Party's service rights. (e) The Territory Boundary was negotiated based on the following considerations and engineering and planning principles: (i) The configuration of each Party’s existing circuits at 12.4 kV and higher, because these circuits are most integral to distribution planning; (ii) Each Party’s installed distribution infrastructure, with the goal of creating an efficient delineation of distribution service from both an operational and planning perspective; (iii) The location of each Party’s respective substations; (iv) Any retail electric service currently provided by the Municipal Utility outside of the Municipality's municipal limits; (v) Prudent utility distribution, operational, planning, design, and engineering principles, with the objective of avoiding unnecessary duplication of facilities in the future and facilitating a least-cost planning solution to avoid unnecessary increases in the cost of serving retail custo...

  • Territory 33.1 This Agreement applies to the territory in which CenturyLink operates as an ILEC in the State. CenturyLink shall be obligated to provide services under this Agreement only within this territory. 33.2 Notwithstanding any other provision of this Agreement, CenturyLink may terminate this Agreement as to a specific operating territory or portion thereof pursuant to Section 6.7 of this Agreement.

Registry Operator must not activate such names in the DNS; provided, that Registry Operator may propose the release of these reservations, subject to review by ICANN’s Governmental Advisory Committee and approval by ICANN. Upon conclusion of Registry Operator’s designation as operator of the registry for the TLD, all such names that remain withheld from registration or allocated to Registry Operator shall be transferred as specified by ICANN. Registry Operator may self-allocate and renew such names without use of an ICANN accredited registrar, which will not be considered Transactions for purposes of Section 6.1 of the Agreement.
