The Bipartisan Budget Act of 2018. The BBA 2018 amended the CMPL to increase certain CMP amounts contained in 42 U.S.C. 1320a-7a(a) and (b). The BBA 2018 increased the maximum CMP amounts in section 1128A(a) of the SSA (42 U.S.C. 1320a-7a) from $10,000 to $20,000; from $15,000 to $30,000; and from $50,000 to $100,000. The BBA 2018 increased the maximum CMP amounts in section 1128A(b) of the SSA from $2,000 to $5,000 in paragraph (1), from $2,000 to $5,000 in paragraph (2), and from $5,000 to $10,000 in paragraph (3)(A)(i). This statutory increase in CMP amounts is effective for acts committed after the date of enactment, February 9, 2018. This final rule updates our regulations to reflect the increased CMP amounts authorized by the 2018 BBA amendments.
