Common use of The Engagement Clause in Contracts

The Engagement. 1. The Customer has engaged the Supplier to supply the services that are described in the Item One of the Schedule (the “Services”) and the Supplier has agreed to supply the Services to the Customer. 2. The parties acknowledge that the Service is provided "as is" and without warranties of any kind either express or implied. The Supplier does not warrant that the functions contained in the API will meet the Customer's requirements, be fit for the Customer's purpose, or that the operation of the API will be uninterrupted or free from errors. 3. The parties acknowledge that the service is supplied on a non exclusive basis.
