Common use of Third Party Software/Open Source Clause in Contracts

Third Party Software/Open Source. Certain components of the Software may incorporate open-source software (“OSS”) or third-party software (collectively, “Third-Party Software”). To the extent required by the licenses covering the same, the terms of such third-party licenses will govern solely with respect to such Third-Party Software. To the extent the licenses applicable to OSS (i) prohibit any restriction in this Agreement with respect to such OSS, such restriction will not apply to such OSS; and (ii) require Honeywell to make an offer to provide source code or related information in connection with the OSS, such offer is hereby made. You acknowledge receipt of notices for OSS. All Third-Party Software is provided on an “as-is” basis, and Honeywell makes no express or implied warranties of any kind with respect thereto and assumes no liability for any damages regarding the use or operation of any such Third-Party Software.
