PARAGRAPH TWO This Agreement shall also be accelerated, upon which the debt shall become enforceable and any disbursements shall be immediately suspended, on the date when any person who exercises a salaried position at the BENEFICIARY or is among its owners, controlling members, or officers is certified or takes office as a Federal Deputy or Senator, as such persons are subject to the prohibitions set forth in article 54, items I and II of the Federal Constitution. No default charges shall be imposed if the payment occurs within five (5) business days from the date of such certification, under penalty of otherwise the charges established for events of acceleration due to default being imposed.
Paragraph 2nd As of January 1st, 2008, the factor of transference X will be established by Anatel based on methodology considering the optimization of the costs of service rendering, as per terms of the regulation.
FINDINGS AND ORDERING PARAGRAPHS The Commission, having reviewed the entire record and being fully advised in the premises, is of the opinion and finds that: (1) Ameritech Illinois and Voicestream are telecommunications carriers as defined in Section 13-202 of the Public Utilities Act; (2) the Commission has jurisdiction over the parties hereto and the subject matter hereof; (3) the recitals of fact and conclusions reached in the prefatory portion of this Order are supported by the record and are hereby adopted as findings of fact; (4) Ameritech Illinois and Voicestream have entered into an Amendment to the Interconnection Agreement dated November 18, 2002, which has been submitted to the Commission for approval under Section 252(e) of the Telecommunications Act of 1996; (5) the Amendment to the Agreement between Ameritech Illinois and Voicestream does not discriminate against a telecommunications carrier not a party to the Amendment; (6) in order to assure that the Amendment is in the public interest, Ameritech Illinois should implement the Amendment by filing a verified statement with the Chief Clerk of the Commission, within five (5) days of approval by the Commission, that the approved Amendment is the same as the Amendment filed in this docket with the verified Petition. The Chief Clerk shall place the Amendment on the Commission’s website under Interconnection Agreements; (7) Ameritech Illinois should also place replacement sheets in its tariffs, located at Ill.C.C. No. 21 Section 19.15; (8) the Amendment should be approved as hereinafter set forth; (9) approval of the Amendment does not have any precedential effect on any future negotiated agreements or Commission Orders.
Sole Paragraph The Concessionaire will present to the competent agencies, whenever required, the reports of environmental impact, as well as will arrange for the achievement of the respective license, as per applicable legislation.
hereinbelow The Bank may notify the Cardholder of the above amendment either through the information provided pursuant to article 4.Α.8 hereinabove or in any other way the Bank sees fit. The Cardholder acknowledges that the Bank is entitled, in the context of its obligation to make personal or other notifications to the Cardholder during the validity hereof, to make use of any electronic means of message transmission, such as e-mail (to the address stated by the Cardholder), SMS, telefax and/or recorded telephone conversation (via the Bank's Contact Center), without however holding the Bank responsible, if it is not its fault, for any error, truncation, delay etc. during transmission of messages in these ways. If the Cardholder does not communicate his objections to the Bank within a period of two (2) months of the aforesaid notification, or if he uses the Card after the lapse of two months, this shall be construed as unreserved acceptance of the respective amendment.
