Time of Appeals. 9.1 Any grievance not appealed from an answer at the first step of the grievance procedure to the second step of the grievance procedure within six (6) working days after such answer shall be considered settled on the basis of the last answer and not subject to further review. 9.1.1 The grievant and/or the Union shall be responsible for timely filing of grievances. 9.2 A grievance may be withdrawn with or without prejudice, and, if so withdrawn, all financial liabilities shall be canceled. If the grievance is reinstated, the financial liability shall date only from the date of reinstatement. Where more than one (1) grievance involves a similar issue, those grievances may be held in abeyance by mutual agreement of the parties pending the disposition of the appeal of the representative case. In such event, the withdrawal will not affect financial liability. 9.3 Grievances which by contract are allowed to begin at a step higher than the beginning step, shall not be deemed defective in procedure if the Union chooses to start at a lower level than provided by contract. 9.4 The Employer will not deny approval to use district property for hearings.
