Common use of Time of Notice Clause in Contracts

Time of Notice. The Supplier must not submit a Notice of Dispute in respect of a Claim for any extra costs, loss or damage unless the claim has previously been submitted to and determined in writing by a representative of the Company. Where a Claim has been submitted to the Company and has not been determined by a representative of the Company within 28 days then the Claim will be deemed to have been rejected by the Company at the end of that time and a Notice of Dispute may be given.
